Companies like United Utilities really don't want this kind of exposure and if your MP got involved and also it was a story in the press, you would find that they would be a lot of anger and it would press them to start moving themselves rather more quickly
    • I've reread your thread from the start, and before we go any further two important questions.   1.  NCP start off by sending their demands to the company, then after a while the letters are addressed to you.  How did this happen?  To be blunt, did you write to NCP and tell them you were the driver?   2.  Do motorists have to input their registration number when they pay at this car park?
    • I'm troubled that you haven't started to discuss quantum yet – at least with your solicitor. Liability is slamdunk so the only question that large is that of quantum. Also, I don't really understand why it is you who are trying to save costs by getting government agencies involved which don't necessarily move very quickly – when the liability is entirely United Utilities and it is they who ultimately will bear the cost of everything. Have you invited them to get involved with clearance? Have you had a full survey of the site by an independent surveyor and if so have United Utilities been given an opportunity to have a look, to comment on your survey and carry out their own independent survey for comparison or corroboration? I have to say that what you seem to be saying about United Utilities bearing asbestos on your land seems to be so scandalous that one of the things I would do is I will try to expose it and I will contact your local member of Parliament. Write to them and then attend the surgery and explain what has happened and explain that a utilities company has been polluting land within their constituency and you need help to deal with it. I can imagine that this is the kind of thing that a member of Parliament would seize upon because it's an easy kill, totally uncontroversial – and extremely popular. Have you spoken to the local newspapers? They love that kind of story. Where are you in the country?

    • Thank you for your quick reply.   There has been no discussion regarding quantum at all, although discussions have been very limited, we appear to be awaiting the actions of Env Health as this helps a long way in saving costs.   If we were to proceed now we would be looking to prove the land contaminated and employing specialists, etc, so the Solicitor has advised its best to use Env Health to do this and save some costs which allows more for the litigation should it be needed.   We have no idea with regard to a value for this and will look to the Solicitor for advice.   Our actual costs will I think be possibly round about the £5k mark   I think based on your reply the way forward is to discuss all these elements fully with the Solicitor   Your comments have been extremely helpful and have cleared up alot of questions I had.

I'm new to the site so would appreciate any help I can get from you guys. I've spent ages looking at some of the posts on here and although a lot of it seems straight forward a lot of it is just mind boggling.

 

I am using mine as a test bed for putting through claims for my friends and family so I am obviously keen to get this right first time.

 

I put a claim in for a SAR with Cahoot (which they received 6/3/07) along with some other banks. Cahoot have until the 15/04/07 as I see it to come up with the request which covers a credit card, a loan and a current account. All of which I defaulted on and since had my accounts managed by the CCCS.

 

I would not be in the position I am in now had it not been for bank charges whilst I was at Uni. I now can't get a mortgage and even find it difficult to get a mobile phone on contract and all because of the chain of events leading form bank charges.

 

Will I get my default taken of my file for all my accounts? I don't know. Will I get to repair my credit rating from this process? I hope so.

 

Please follow my case and help as much as possible.

 

Just to confirm if I don't receive the statements do I then (1) inform the ICO (2)Send them an LBA and then (3) Launch a Court Order all at the same time. Or do I wait till the days are up after the LBA to raise the court order.

Hi Striker,

 

Welcome to the site.

 

If you don't get your statements on time send the LBA then after the time has expired in the LBA complain to the ICO and make a court action. But hopefully it won't come to that. :)

 

Removing defaults is a little more tricky. Some companies are obliging and others are a little more obstinate.

Right I've sent my Prelim letter off to Cahoot today. Charges totalled (with interest) £1200.

 

Giving them 14 days before I put my foot down.

 

I hear they refuse point blank to pay out. I'm a bit worried though as I sent everything to CCCS a few years ago. Will Cahoot demand all the money back or will they still honour the payment agreement with CCCS. I thought that if they give me £1200, then they would expect me to give it back to reduce my debt.

I'm also claiming though Natwest, Barclays and Barclaycard, all of which have not complied with my DPA request. Some have but only sent me half the statements, Barclays haven't sent me anything. 40 days are up now so LBA sent today.
