    • I (and other respondents) always advise “not getting caught in a lie” it hardens their response. Why would they now believe protestations of remorse and “I won’t do it again” if they've already seen you'd lie and say it was a one-off when it wasn't..  You can try approaching the prosecutor on the day, but "I wouldn't hold my breath" …..  
    • I told them that it was an accident and that I used the oyster card as my debit card was lost. However, they did an investigation and realised it was not a one off. I have told them how remorseful I feel and how a criminal conviction would result in expulsion from my degree but they still want to take me to court. I have received the court summons letter

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello all,

becoming more stressed by the day sent the standard 3 letters and recieved the standard mumble jumble back. issued court proceedings for £3558.00 recieved a Notice that Acknowledgment of Service has been filed, within this they (the Abbey) intend to defend all of this claim. Please could anyone tell me what is likely to happen next has myself and my partner have just had a baby and are very worried of incuring any more finacial problems that my arise from these proceedures. thankyou in advance with your time and effort in reading and possibly replying.

:confused: Hello again everyone,

some more infomation required if possible, proceeding with court action against abbey via small claims court (northampton) abbey have declared there intent to defend and i recieved i the post on thursday that they are reviewing the claim and preparing a response and a defence will be filed in due course.

in the meantime they note that i have claimed the sum of £3438.00 in respect of charges that i say have been made to my abbey account they appreciate that i may have previously forwarded details of my claim to there internal complaints department however we do not have acces to that information and to expedite the processing of my claim could i therefore provide them with

 

(1) account number

(2) details of how i have calculated my claim by date and amount of each charge claimed

(3) details of how the intrest is calculated, showing how interest is calculated by refrence to each charge.

 

is this a standard letter and should i send them these details they also require my telephone number please what should i do

many many many thanks in advance.

I haven't quite got to this stage yet, but having read some of the threads here, it looks like a standard response!

 

There must be so many departments at Abbey how can we expect them to communicate with each other?

;) (Ha,ha,ha!)

 

If you look at some of the threads here and some of the ones in the Abbey successes bit then you'll see that your letter is the same as many others. And you probably should send them a(nother) copy of your schedule.

 

It's up to you whether or not you want to give them your phone number - I suppose it depends on whether you want them to be able to contact you by phone, or whether you prefer to have copies of your correspondence with Abbey (and time to work out your responses) in which case email or post is better!

hi everyone at bow county court tomorrow has of yet case has not been stayed when i called court on friday and she remarked that normally they have been recieving letters from banks requesting stay's but not in this instance so she thinks the case will probably be heard any advise on what to expect will be much appreciated. many thanks in advance chill.

just to let you know case was stayed (for a change) because of the poxy OFT and there stupid agreement with the enemy before they represent me I wished they would have asked. now back to the waiting game but i have a bad feeling about this now has far has i am concerned the OFT have helped the banks to stop leaking money my anallgy of it is the banks have a bad cut the OFT step in to reduce blood flow now banks go off to hospital for full recovery and us the leaking blood are put back where we belong IT ALL STINKS IF YOU ASK ME!

Hi Chil, can understand you are bloody annoyed, Now is the time to get coat off and start fighting back. first read up threads re stays then apply to court to have stay set aside. who applied stay was it court or Bank?

You now have the option to apply for the stay to be set aside or wait the outcome of the test case, which could take 2-3 years as the banks openly admit on their websites, and that they will appeal if they lose and this could take the same amount of time. It is my opinion that the banks are using this as a delaying tactic, if they weren`t, then why are they still settling claim before going to court. It will cost you £35 to apply for stay to be set aside, and you will have to prove your reasons for this. take a look here: The Stay - Here is the application grounds for the removal of the stay

 

You can personalise this to suit your own case by adding to the start, but do not alter the rest as it gives human rights grounds, If you can prove hardship or some other grounds then use them.

 

The final decision how you go must be yours, but if you apply for stay and lose then at least you will have the knowledge that you gave it your best shot.
