Recommended Posts

Sent DPA and received statements and calculated charges at £60 in respect of returned direct debits on a loan. Sent letter requesting repayment and received the following from CitiFinancial:-

 

" On 5th April 2006 the Office of Fair Trading (OFT) issued a statement regarding the default charges levied by credit card issuers for breaches of contract and have recommended that credit card issuers review their position and respond to the OFT by 31st May 2006.

 

We would respectfully point out that the OFT's direction specifically relates to credit card issuers and not to loan providers.

 

Notwithstanding the above, we believe our charges are fair, transparent and lawful and have been applied to your account in accordance with our contractual arrangements. Accordingly, we are not prepared to repay the sums requested.

 

We trust that this letter clarifies our position on the matter."

 

I never mentioned anything in my letter about the OFT and although the sum is not great, a Letter before Action is on its way. They have obviously never read this site!!!

Response to LBA - "I have reviewed your letter and would refer you to our previous response which is our final response on this matter."

 

I don't think so! - wait until they get the Small Claim summons from the court!
