      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have this morning received another letter from MJ taking out the conditional settlement but the amount of money is exactly the same. I don't know what to do now. Any help most appreciated.

Write back, saying, "no, XXX is the amount on my court claim, unless you have proof that the amount in dispute is less than what I have claimed, I failt to understand why you are not paying in full. yours , etc..."

 

Well done, you have them on the run. Stick with it, you'll get your 100% charges. (and owe me a large drink, lol)

Settled in full, the money ws in my account at approx 12am this morning plus a big plus for me they have assured me they will not be closing my account and they have re issued my debit card/speedbank card, cheque book and if i want it overdraft lol I'm absolutely amazed

What i am totally amazed at is the fact that my full current account is being restored. It had previously been with their collections dept. for 18 months paying a debt off they now say i can it back even thought my credit rating is absolutely dire.

I have jsut tonight plucked up the courage to start against Lloyds TSB.

I reckon deep down that I have thousands owed to me, at least 200 a month aver the last 6 months, before that i stayed debt free for about 2 years but the 4 years prior I was diabolicle, again at least 200 a month in charges, really messed me up to the point i couldnt afford electricity!!! I know.

~I hope I get as much support as yates did.

Good luck if i can do it anyone can and i am more than sure youwill get as much if not more support than i did. I know what it feels like not to be able to pay the electricity bills or put food on the table. I am terrified of spending one penny of this money in case i need it in the future.

Yep definitely sleeping better. It got rather hairy though back in June when their collections dept. stepped up the harassment of me on the telephone. I was receiving 3 calls a day 6 days a week and when one the callers called me a liar over the phone that's when i lost it. Not with her i put the phone down on her but with Lloyds in general. I sent very angry and to the point email of complaint in detail to their head office. This week i received a letter of apology saying they were re training their staff. Proof they do record their calls. I could of given up at that point quite easily and probably would of done but for a friend who used to work for RBS, thankfully i didnt:)

I know just what you mean about been frightened to spend.

We had lived on benefits for almost 2 years, then my mum died, and all of a sudden I had money in the bank and I seemed to lose as much sleep worrying about spending it all, it was almost as bad as the time I didn't have any at all.

 

At least now us and many others are getting some security behind us, thanks to the forerunners on this site instead of the bl...... banks getting richer
