not sure if I'm right starting a new thread for this... apologies if I've done it wrong! I received a notice of transfer of proceedings yesterday saying AQ should be returned to my local county court (oldham - no problem) however, attached to this document is an order from a Judge (sitting @ northampton) that the court of transfer is BOLTON (?!) and that the filing of an AQ be dispensed with in this case. Help! what does this mean?! why no AQ? Which court have I been transferred to, Bolton or Oldham? and finally, what happens next?! sorry for all the questions so early in the morning but I've been stressing about it all night!

from what ive read lately it seems that judge's are missing the AQ part out ton speed the cases up as the banks have no intent on actually defending.

 

I think it is a good thing probably saves around 3-4 weeks.

thanks mattyb13. in theory, that sounds like a good thing! what will happen next? also which court would you think is my court of transfer, oldham or bolton - hard to tell from what they've sent me...

cheers livelylad. What should I be doing next? I was waiting for my AQ then going to get cracking on my bundle this weekend. I'll still get on with the bundle but what's the next step do you think? (also intend to ring court to ask for oldham not bolton

- muppets, bolton's miles away.)

problem solved! spoke to oldham county court - they said the bolton bit is a typo (!) and that the judges @ northampton are leaving it up to the local county courts to send out AQs or not. (due to the high number of these sort of cases) So I probably will be getting one at some point in the near future. Hmmmm.

Let's hope that dispensing the filing of the AQ will become the norm, it will not only speed up the whole process but also save the £100 fee. (My case was stayed by the judge so I've now had to file two AQ's!!)
