    • Hi All,  I have tried to use my own words as much as possible, any better suggestions are welcome.  I have been sleepless and hence i can't really think of alternative words, will definitely give it another go if you have points that i may have left out? Worry
    • Thanks all for all your input. I have decided to follow this all the way. So far, I have not replied to Alliance Parking's original NTK letter. The time-period for the reduced amount has now finished, and the time to appeal (21 days from the date of letter) will finish on 25th Apr. No further comms received from Alliance Parking. Could you please guide me, for my readiness, on what happens next? Am I going to start receiving letters from Alliance Parking > Debt Collector letters > Letter of Claim? Who sends me the Letter of Claim - Alliance Parking / Debt Collectors / Solicitors / court? How many weeks / months from now is this likely to be? Once Alliance Parking passes the debt off to the Debt Collectors, is there a risk of anyone turning up at the door? Do I need to reply to any other letters from either the parking company, debt collectors, or solicitors? Many thanks in advance.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

This is my first post on CAG, although, I have been reading up from here and Moneysavingexpert.com for a few weeks now. In case anyone is interested, I am reclaiming from:

 

Nationwide - £3340

Nationwide - £2969 (on behalf of my wife)

Capital One - £309

 

So far, I have sent the first letter for all three accounts. Unsurprisingly, Nationwide have refused saying their charges are fair (blah, blah, blah), and Capital One have refunded £112.00.

 

Due to amounts that we're claiming, and the fact that we live in Scotland, I have sent the forms away to the FOS, with all relevant correspondence. I'll see what response I receive in due course, but I won't hold my breath. If I'm not satisfied then I will raise court action. I did it in this order, as if you approach the court first, you can't then go through the FOS (or so they say). Incidentally, since I sent my initial letter to the Nationwide, they have downgraded my Flexaccount to a No Withdrawal account, as I went over my overdraft limit by £11! Coincidence or not? If I need to withdraw money, I have to phone them to get them to authorise it, then go into a branch, which is a complete pain in the 'arris. I was initially worried when I started this that they may close my account, but now, I'm not bothered, as they have effectively removed my ability to run my account anyway. Fortunately, my wife still has her account, so we're using her account as our main account now.

 

I will pursue Capital One for the difference in my claim with them, I was going to let it lie, then I thought, "Sod it, they would hound me for £190-odd, so I'm not letting them away with it".

 

I'll let you know how I get on.

We are now recommending that Scottish claims over £750 are put through the FOS, as the Scottish courts have put the block on some second and subsequent claims on the same account where the claims have been split to keep in the small claims.

You should be OK with the FOS but due to high numbers of claims, it may take a little time.

I read your thread with interest, because I'm going for both Nationwhine and Crap One at present.

 

Nationwide seem to have stopped closing accounts in recent weeks, but I've not read of a downgrading before now. Given that people have sucessfully complained to the FOS about the account closures from various banks, I wonder if you should report this to them?

 

I also wanted to comment on your incorrect use of rhyming slang, which could confuse some readers.:confused:

 

You said "complete pain in the 'arris", when you should have said "complete pain in the khyber", (from Khyber Pass).

 

Aris is quite different, from Aristotle/bottle, as follows.

"Reclaim his bank charges by taking them to court - he hasn't got the aris!":lol:

"Champagne? moi? When I get my charges back I'm gonna drink the whole bloody aris!":lol:

 

I hope you don't mind me pointing this out, but as I'm getting into practice for my litigation against these people, I like to get the facts absolutely spot on! ;)

Further to my earlier post, I've just returned from holiday to discover two letters from Nationwide offering to repay all charges from May 2001 on both my account and my wife's account.:D:D:D:D:D

 

My refund: £3701.50

My wife's refund £3682.50

 

I expected to wait for months before getting any joy from the FOS, but the whole process from initial letter to Nationwide to completion has only taken ten weeks.

 

Needless to say the accepted offer letters have been signed and returned today. This has saved me the hassle of going through the courts, especially as I'm in Scotland and due to the amounts, I was expecting to have to raise a claim in the English court system.

 

Seems like the Financial Ombudsman Service may be the route to go down if you don't fancy a court battle, it certainly worked for me!!!!!!;)

Thanks for your comments Varangian, but I wasn't using rhyming slang, I just didn't want to type 'arse', as this is a family show. The 'arris I was referring to was the island of Harris (as in tweed). Aristotle hasn't got anything to do with it.

 

Anyway, thanks for your concern, but since we've just been refunded £7500, I don't give a toss.:smile::smile::smile:
