    • I'm still pondering/ trying to find docs re the above issue. Moving on - same saga; different issue I'm trying to understand what I can do: The lender/ mortgagee-in-possession has a claim v me for alleged debt. But the debt has only been incurred due to them failing to sell property in >5y. I'm fighting them on this.   I've been trying to get an order for sale for 2y.  I got it legally added into my counterclaim - but that will only be dealt with at trial.  This is really frustrating. The otherside's lawyers made an application to adjourn trial for a few more months - allegedly wanting to try sort some kind of settlement with me and to use the stay to sell.  At the hearing I asked Judge to expedite the order for sale. I pointed out they need a court-imposed deadline or this adjournment is just another time wasting tactic (with interest still accruing) as they have no buyer.  But the judge said he could legally only deal with the order at trial. The otherside don't want to be forced to sell the property.. Disclosure has presented so many emails which prove they want to keep it. I raised some points with the judge including misconduct of the receiver. The judge suggested I may have a separate claim against the receiver?   On this point - earlier paid-for lawyers said my counterclaim should be directed at the lender for interference with the receiver and the lender should be held responsible for the receiver's actions/ inactions.   I don't clearly understand that, but their legal advice was something to do with the role a receiver has acting as an agent for a borrower which makes it hard for a borrower to make a claim against a receiver ???.  However the judge's comment has got me thinking.  He made it clear the current claim is lender v me - it's not receiver v me.  Yet it is the receiver who is appointed to sell the property. (The receiver is mentioned/ involved in my counterclaim only from the lender collusion/ interference perspective).  So would I be able to make a separate application for an order for sale against the receiver?  Disclosure shows receiver has constantly rejected offers. He gave a contract to one buyer 4y ago. But colluded with the lender's lawyer to withdraw the contract after 2w to instead give it to the ceo of the lender (his own ltd co) (using same lawyer).  Emails show it was their joint strategy for lender/ ceo to keep the property.  The receiver didn't put the ceo under any pressure to exchange quickly.  After 1 month they all colluded again to follow a very destructive path - to gut the property.  My account was apparently switched into a "different fund" to "enable them to do works" (probably something to do with the ceo as he switched his ltd co accountant to in-house).   Interestingly the receiver told lender not to incur significant works costs and to hold interest.  The costs were huge (added to my account) and interest was not held.   The receiver rejected a good offer put forward by me 1.5y ago.  And he rejected a high offer 1y ago - to the dismay of the agent.  Would reasons like this be good enough to make a separate application to the court against the receiver for an order for sale ??  Or due to the main proceedings and/or the weird relationship a borrower has with a receiver I cannot ?
    • so a new powerless B2B debt DCA set up less than a month ago with a 99% success rate... operating on a NWNF basis , but charging £30 to set up your use of them. that's gonna last 5mins.... = SPAMMERS AND SCAMMERS. a DCA is NOT a BAILIFF and have  ZERO legal powers on ANY debt - no matter WHAT its type. dx

    • You could send an SAR to DCbl on the pretext that you are going for a breach of your GDPR . They should then send the purported letter of discontinuance which may show why it ended up in Gloucester and see if you can get your  costs back on the day. It obviously won't be much but  at least perhaps a small recompense for your wasted day. Not exactly wasted since you had a great win  albeit much sweeter if you had beat them in Court. But a win is a win so well done. We will miss you as it has been almost two years since you first started out on this mission. { I would n't be surprised if the wrong Court was down to DCBL}. I see you said "till the next time" but I am guessing you will be avoiding private patrolled car parks for a while.🙂
    • It is extremely disappointing that you haven't told us anything about the result of the hearing. You came here at the very last minute and the regulars - all unpaid volunteers - sweated blood trying to get an acceptable Witness Statement prepared in an extremely short time. The least you could have done is tell us how the hearing went, information invaluable for future users. Evidently not.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I became disabled in 2002 and am unable to work. I have a small works pension and benefits and have to pay a large contribution towards 24 hour care.

 

I had a loan with the Bank of Scotland and I could no longer keep up with the payments. BOS passed the loan to Legal and Trade. They have been collecting the money and I get statements from BOS. I have at no time had a letter of assignment from BOS and the fact I get statements from them led me to believe the loan had not been assigned to Legal and Trade and that the latter were only acting as a collection agency.

 

Every month I have paid the agreed amount by phone - it is roughly one-third to interest and two-thirds to capital, so the amount has been coming down. L and T kept sending me letters to say in view of my commitment to paying the loan they could offer me a substantial discount but I couldn't clear it. Then last Saturday out of the blue I phoned to make my usual monthly payment and the operative said they were being asked by BOS to get increased payments from me. I said I couldn't do that - it was my usual amount or nothing. He said they would just have to take me to court then. I sad "Fine" and that was the end of the conversation.

 

I wrote to BOS and they have replied that I had to deal with L and T - no explanations. I have written again asking who exactly owns this loan.

 

I am in the weird position where a debt collection agency won't take my money! What bothers me about it most is that since they won't accept payments that is just going to add interest and that is unfair - and I really want to get rid of this loan.

 

Any and all advice on this would be appreciated. Nust or what?

and wait see what comes back

 

if you dont know what a CCA is come back and ill give you the template.

It does sound as if they are collecting on behalf of BOS, so there would be no Letter of Assignment.

L and T kept sending me letters to say in view of my commitment to paying the loan they could offer me a substantial discount but I couldn't clear it. I said I couldn't do that - it was my usual amount or nothing. He said they would just have to take me to court then. I sad "Fine" and that was the end of the conversation.

 

I have to say that this sounds very similar to one of my scenarios...paying for several years... sudden 'phone call wanting to up payments... followed by threats of a property charge, etc.

 

I wrote to BOS and they have replied that I had to deal with L and T - no explanations. I have written again asking who exactly owns this loan.

The most obvious route would be to send a CCA request to L & T.... I will post the template on here shortly....

 

This is a legal request for your Consumer Credit Agreement (under the Consumer Credit Act, 1974)... most types of borrowing are covered by it, including bank loans. L & T have 12 working days within which to comply with your request, after which they are legally unable to pursue for any further payments.

 

If they are acting on behalf of BOS, they will then pass the account back to them and you can then deal with BOS directly.... by issuing a SAR to see if any unlawful charges have been added to the account. You can then re-claim these.

 

Under the circumstances, I would be inclined to forget the charges for now and send a CCA request to BOS as well.... because if no-one can produce it, then no-one gets any further payments from you until they do.

 

Please remember to send the CCAs by recorded delivery as this is your only proof that a request has been made. I will go and get the link for you....

I need out find out who actually owns this loan. Are agencies not allowed to charge interest?

Hi pinky69 I have been in a very similar position as you are in now, my wife and i are both disabled and due to having to care for my wife my own health suffered. I had to take early retirement due to this. As you I have a small private pension and benifits. Dont get me wrong I get plenty but just as you I have to pay a good deal for carers. To cut a long story short I could not manage financialy and needed help. A friend pointed me to a debt management company they got in touch with all my creditors and arranged to freeze interest and charges on a total debt of approx £12000. They worked out the amount I should be able to pay £230 on an income of £1200 every 4 weeks. I think you could try this route also send a CCA request to both BOS and Legal and Trade so you know who owns the debt and if you have any charges on the debt then advise them debt is in dispute and send a SAR letter. This may give you time to take a breath and think about what you want to do now.

You could have done this yourself.... £230 still seems a lot for you to pay out on £1,200. Are you paying the DMP for their services ?

 

I think you could try this route also send a CCA request to both BOS and Legal and Trade so you know who owns the debt and if you have any charges on the debt then advise them debt is in dispute and send a SAR letter. This may give you time to take a breath and think about what you want to do now.

 

The debt is in dispute as soon as a CCA or a SAR is received.

A SAR is a Subject Access Request... and is a legal request for all transactional data that a company holds about you, including payments, charges, 'phone calls, etc.

 

If you decide to go down this route, I will give you the link... but at this stage, you need to send a CCA (rec. dellivery) to L & T immediately.

I have done the letters for L and T and BOS and will get them off tomorrow. Hopefully whoever has the loan won't have a copy as it is now regarded as an "old loan". We'll see. I'll get back to you when the 12 days is over.

I am blushing... :oops:

 

If they have not complied within 12 working days, they are in default of your request and can no longer pursue you for payment without producing the doc. in court. :D

 

If they go an additional 30 days without producing the doc. they will have also committed a criminal offence if they continue to harrass you for payment towards a disputed debt. :D

An interesting development. My registered post request for a CCA has been received by the Bank of Scotland but not by Legal and Trade. They should have received it by this time - even with the holiday. Are they avoiding it? Do they refuse it as a matter of course? Anyone any ideas.

If you checked on the website.... sometimes it doesn't show up for a while, so try ringing the number on the back of the rec. delivery slip. One of mine didn't sign straight away though....

Great you have time off!

 

I am not really worried because after I couldn't work I went through a bad time and came out the other end successfully. This is more a carbuncle on life's bum ( are you allowed to say "bum" on here?). This debt was coming down nicely and now they have become awkward for absolutely no reason. One thing that intrigues me is that since they made the threat of court nearly 2 weeks ago I have heard nothing from anybody- I was expecting the usual barrage of phone calls. They haven't a leg to stand on if they do go to court. I have been paying this regularly for 3 years and I cannot afford to pay anymore. I have 24 hour care and have to pay £135 per week towards the cost. No court would order me to pay more so this is just crazy. I am now really angry about it and I am normally placid but if I get my way they won't get another blasted penny! Ha!

The plot thickens!

 

I spoke to Royal Mail today and my Special Delivery letter is sitting in L and T's PO Box waiting to be collected. If they can collect other mail, why not my letter??? Royal Mail said there is an agreement that they must collect their mail once a month.

 

I wonder where this leaves me as far as the 12 day period is concerned? Do I back this up sending them a copy of the letter by ordinary post? I still haven't heard a word from them - now almost 2 weeks. Weird.
