BEET is due in court tomorrow but cannot get time off work. :-o

 

So far SCM have not submitted their court bundle despite non-compliance letter. Just checked phonebank & they have not paid up.

 

Any suggestions? Is there a letter I can fax to the court to apologise? Will the case be thrown out if Beet does not attend?

Strikes me that SC&M will almost certainly not turn up either - but don't thing it would look that good if the claimant wasn't there. There must be some provision for this sort of thing although not sure what it is - have you spoken to the court?

What Time Is Your Case Booked In For?

claim with woolwich for £1895. offer recieved for £1412 . rejection letter sent on 05/04/07.

claim with capital one for £987 for two accounts, preliminary sent 02/04/07

still waiting for full statements for husbands capital one.

gemoney sar sent on 03/03/07. on 3 accounts. cheque cashed.

barclays bank sar sent on 03/03/07. had response and cheque returned, but still no statements.

monument sar sent 03/03/07. phone call from monument to say they are dealing with my request.

If both parties don't show the whole case can be struck out.

 

If the claimant doesn't show the claim can be struck out.

 

In both cases the claimant can apply to have the claim restored, if there were reasons that the court thinks that there was a good enough reason for the absence.

 

Any judgment that's given in your absence can be set aside if the hearing is restored.

 

 

I'd get on the phone first thing and ask if it can be adjourned to a later date. I'd also phone SC&M to see if they're sending anyone.
