A new DCA has appeared recently which seems to flout all civilised and decent behaviour. They have applied for a charging order on someones house for the cost of applying for the order (£55)

They are called IND and I believe that they have bought a job lot of debts from Morgan Stanley.

I would be grateful for any information or help any one can give me (pm me if you prefer)

Thanks

J

my friends case finally went to court today fo the charging order to be decided. IND claimed the court cost of issuing the order and their expenses plus registering it at the Land registry.

Unluckily for them the judge refused the order and allowed cost to my friend, (travelling costs plus lost wages) to be paid within 14 days.

- lets wait and see if they pay up

Excellent news. Thanks to sites like this the ordinary man in the street is aware of his rights now and some of these companies will realise they are not invincible. The sooner they change the way they deal with folk the better all round. Debts will be paid more often if compnies used a less confrontational manner.

  • 2 weeks later...

The 14 days are up I.N.D are now in default.

It seems likely that they will be difficult to wring the cash out of so bailiffs dont seem to be an option. any advice would be welcomed.

I have sent a letter to Companies House and to HM Revenue and Customs about this company IND and Flyboat (or lack of it).

Not much help to you right now but at least the authorities will take notice.
