Hi folks. I've already successfully claimed against HBOS up here in scotland, but Ive now got a query. Can I claim in the scottish courts against Barclays (My account was always at an English branch).

 

If I need to claim through the English legal system, can I use the money claim online thing having a Scottish address, if not do I just use the address of a relative? Hope someone can help!:roll:

Have you looked through this thread http://www.consumeractiongroup.co.uk/forum/scotland/ or you could do a search for scottish claims, there were people asking the questions as yourself but getting conflicting answers so i really wouldnt like to say 'yes or 'no to yours.

its not much help, but something i suppose.

Can I use MCOL?

 

You cannot use MCOL if you are:

And you cannot issue a claim using MCOL against:

  • a child or patient (as stated above);
  • the Crown, including Ministers of the Crown in their official capacities and government departments.

Other Conditions:

  • your claim must be for a fixed amount of money which is less than £100,000 including court fees and any solicitors' costs';
  • your claim is against no more than two people;
  • your address for service must be within England and Wales
  • the address of the person(s) you are suing is within England and Wales; and
  • you have a valid credit or debit card.

If you think you qualify for a fee remission or exemption you cannot use MCOL.

Thanks guys! I gave MCOL a ring anyway, the very helpful lady said I can put down an English Address as the service address in the claim and therefore claim under the English system. When I told her it was bank charges she said the only way to claim in Scotland is if I have an address for barclays in Scotland, so I think I'll go down the MCOL route.
