Hi

 

Are there step-by-step instructions or even just some general advice on this site for raising a claim via Summary Cause?

 

I've seen a lot of info on raising a Small Claim, is the process similar or do I need to do a lot of reading beforehand?

Hi, FMB.

 

The process is the same as Small Claims, the form is on the Scottish Court thingy. When you submit your Summary Cause it will cost you £39.00. The court will then send your papers back and you will have to get a Sheriff's Officer to serve them on the Bank. This cost me £15.97. The court will send you a list of local Sheriff Officers you can use. If you were to loose a Small Claim you only loose your £39.00 court fee, but if you were to loose using Summary Cause you would be lible for the Banks Solicitors fees. I was told this would be in the hundreds rather than thousands and you would have to be the unluckiest person on the planet as no one has lost yet.(well as far as I know).
