Mistake on MCOL, advice needed.

Help!! I've just realised that I've made a mistake on my MCOL, I calculated the daily interest figure wrong and it's a few more pence per day than what it should be. Instead of multiplying the total charges by the 0.00022 I multiplied the total chares plus the interest up to the preset day by 0.00022.

 

Can I get this changed? Will it be all right to leave it?

I think I might leave it. As barclays can query it when we come to settle. I won't try and claim anymore as I have the spread sheet to tell me what the amount will be.

Will it be all right to leave my claim saying

 

"Continuing at 8% until judgment or Settlement at a daily rate of £0.49"

 

when is should have said

 

"Continuing at 8% until judgment or Settlement at a daily rate of £0.36"

 

I rang the court they wouldn't say one way or another.

You can make an amendment to your claim and it will cost £35. I had to make an amendment to my claim because I had not claimed for the 8%interest. I'm not sure what the process is with regard to MCOL as I did mine via taking papers to court. Try giving them a call. If you want to see what the process is have a look at my thread

I've downloaded the N244, I need some help filling it in and just general assurance that Im doing it right.

 

In the right hand box for the following

 

In the {not sure what goes here Northampton County Court maybe}

Claim no. {my claim number}

Warrant no. {I presume nothing in here}

Claimant {this must be me}

Defendant {Barclays Bank Plc}

 

For part A:

 

I my name

intend to apply for an order that amends my particulars of claim

because my particulars of claim claimed the wrong daily rate of statutory interest allowed by s69 county court act 1984

 

For Part B

 

ticked the evidence in part C in support of my application

 

Do I need to put anything in the address box?

 

For Part C

 

Please find attached the new particulars of claim, with the amended daily rate of statutory interest allowed by s69 county court act 1984 (Do I just attach a print out of my new POC's)

If the only problem is that the daily rate is wrong by 10p or so, I really would'nt bother with an amendment. Its disproportionate and unnecessary IMHO.

Cheers for that Gary, that's what I thought. I rang the MCOL help desk and they could not advise me if I should or shouldn't do it only on how to do it. I think I'm going to run with it then.

I agree with Gary, if it is the interest, this will be changing daily which as you know is shown on the spreadsheet every time you open it.

As long as you are happy with the figures when the time comes to settle with Barclays, thats all that matters really isnt it.

 

I doubt neither the court or Barclays will have even took the time to check the details on your claim anyway.

Hello peeps, My claim has been 34 days since it first started and it's still sitting as 'acknowledged'. I presume I'm entitled to start judgment now?

hi,

I would contact the mcol helpline and see how your claim stands at the moment as barclays may have entered a defence, it may not be updated on the site.

Sometimes asking for judgement can delay the claim by 28 days.

Barclays have not entered a defence and the MCOL system let me go for Judgment by Default. But I've read cases of barclays submitting there defence later on in the day. Will this most probably happen to me?

If they have not filed any defence, you should receive a letter from the court in a few days to say that your judgment has been filed and served on the defendant. At that stage, Barclays must pay you your money as claimed or you could order Bailiffs through MCOL.

I hate the MCOL faqs, they are so confusing but I found out this and thought I would share it.

As I entered jugment after 9am it won't go through untill the end of the next working day, meaning that if barclays entered a defence before 4pm tomorrow it will still count. If I had entered before 9am today barclays would have had till 4pm this afternoon.

 

We'll wait and see what happens.

Well they defended, at least it's another step along the way.

 

How long roughly will it be now till I get a court date?

Hi Shuff,

 

BB defended my claim today as well, although they were 11 days early in defending mine.

It will be interesting to see who gets a court date first, I will keep an eye on how things go for you

Well, I got the Notice of Transfer of Proceedings on the 10th of May and have not heard a thing from my local court is this normal?

Finally got a court date while I was on holiday for the 13th August.

 

I've got to do a bundle now. And I've been reading that you need the terms and conditions, luckily the CAG has mine from 96 (I can't seem to see anything about charging on them). Where do I insert them in to the bundle?

Bump, Could someone point me in the direction of a Barclays specific Statement of Evidnece. I've searched all over but can not seem to find one. I've got to get my bundle in the post tonight and seem to be running out of time. Cheers.
