Hello,

 

I have now been offered £1100 from £1466 worth of charges. I sent Barclays a letter 10 days ago stating that I wanted the full amount and for them to notify me within 7 days this would happen and they are refusing.

 

What is the next stage - do I fill out the application to take them to court or contact the ombudsman?

It really depends on what you've already sent them as to what the next stage is.

If you have sent them the Prelim letter and LBA, then if would file with either MCOL or N1 form (after you have given them 14 days after the LBA was sent) Or if you have only sent them the prelim letter then you would need to send LBA (again after 14 days of orginal letter sent)

Thanks - sorry to be a pain but the acronyms you use do not mean much to me. What is MCOL and LBA. I have been in dialogue with them about this since mid January so they have had way longer than 40 working days.

Does anyone know how to calculate the interest owed on charges when filling in the N1 form. The guidance I have says 0.00022 x 1000 for every £1000 owed, per day. This is understandable but how do you know how many days as all the amount owed changes on different dates when the charges occur ???? Do I just work it out approximately and send in this figure.

I was not going to bother but this amounts to a few hundred quid and Barclays are being so bl**dy awkward over the whole thing ??

...at a daily rate of £0.xx; - This daily rate of interest is calculated by multiplying the total value of the claim (charges plus overdraft interest, if claimed) by 0.00022

For example,

£1,429 in charges

£27.40 in overdraft interest

Total £1,456.40

1466.58 x 0.00022 = 0.32 - This would therefor be £0.32p on a daily basis.

Please ensure you do your own calculation based on your totals

Thanks but I am still a bit stuck.........I started picking up charges on my account in 2002, when the total charges would of started at zero. By 2004 my charges, in total were over a grand. Do you see what I mean ?? Obviously the amount of time has changed as more charges have been added.

 

Or are you saying it is calculated back to the date for the very first charge for all charges ??

I have recently submitted all of the documents to the courts for my charges and have recieved a letter back stating Barclays wish to defend the case and have 28 days to supply a defence. Is this anything to worry about or are they just stalling for more time?

Does this mean they will probably contact me on the 27th day and offer the full amount ?

Hi,

This is absolutely standard. They'll file their defence as late as possible (sometimes even after the deadline!), but don't expect them to try and settle until just before a court date, because they won't.

 

And shouldn't it be 14 days anyway? 14 days to acknowledge (which they have), then a further 14 to enter a defence, innit?

 

You may be lucky; sometimes they just 'forget' to defend, and you'll win by default.

It means that Barclays are planning to defend your claim.

 

Within the 28 days (from issue) they will submit their defence to the courts.

You will receive a copy of this.

 

YOu will than probably receive an AQ Allocation Questionaire to fill out.

 

Once this has been done a court date will be issued,

 

Barclays will then settle just before this date (probably a few months from now)

 

The best thing to do now is to read up on the process then you will know what to expect at every turn.

 

YOu have issued a claim which you may have to defend in court and you have done this blindly until now.

READ READ READ, make sure you know the process and everything should go fine

I now have a court date against Barclays at Bromley court for 3rd August, which I cannot make. Should I re-arrange this now or leave to nearer the time in case they settle. Do I have to be present? Can you claim loss of earnings to go? I have paid the court 120 quid - how do I claim this back?

All of this depends on whether I win or not of coure!!

 

Any help from anyone would be greatly appreciated - cheers!

I have been given a court date of 3rd Aug against Barclays and I am away on this date. Would I be best to notify the court immediatly or wait to see if Barclays settle beforehand? My claim is for £1950, about £1450 in charges plus the interest up until 2 months ago. I paid Bromley court £120 - how do I claim this back if I win?

Welcome to the site.

I think you should inform the Court ASAP and tell them.

By giving as many dates as possible between now and then when you ARE available,may just give you an earlier hearing.

You are not obliged to inform Barclays thats the Courts job.

I am not sure that Barclays would settle any earlier than possibly a week or so before the hearing date.

If you left it until then to inform the Court of your unavailability it will not look too good for you.

 

The Court fee should have been added onto your N1 claim form and there is an additional 100.00 if you paid for allocation fee.

Barclays will add this in with their settlement.

I seem the remember on my N1 form that the the total amount was £1950 so I did not add the charges - I must of been presuming the court would do this. Does this mean I will lose the £120 I paid the court? If I wanted to change this would it then put me to the back of the queue for court dates?

Realistically you are only entitled to whats being claimed within the claims form.

If you made an ammendment it would cost you 35.00 and is unrecoverable.

Since you already have a Court date it would not affect that.

You could simply draft a letter to both Court and the banks Litigation team stating that settlement will only be considered final with all charges,costs and any interest payable being paid to you.

I am now getting completely confusing messages. Barclays have written to me with a vague letter that all court dates will be 'stayed' but not specifically mine. The court however are saying it will go ahead as planned on 27th Sept. Barclays have then written to me saying their original offer from 4 months back will stand for the next 2 months ( this was just over 50% of the amount). I have just called Barclays to clarify and they are saying it is not 'stayed' but they will apply for this at the court on the court date.

 

What does all this mean? Are Barclays bluffing?
