    • I have received a PCN from Euro Car Parks for MFG - Esso Cobham - Gravesend. I was completely unaware that there was any such limit for parking and always considered this to be a service station. I stopped there to use the toilet, have a coffee and made a couple of work calls. I have read the previous topics on this location which suggest I can ignore this and ECP will not take legal action. The one possible complication is that the vehicle is leased by my employer so I do not want to involve them with the associated reminders and threatening letters. The PCN was first issued to the leasing company Arval who have notified ECP of the hiring company. I have attached a copy of the PCN Notice to Hirer with details removed as per instructions. What options do I have or should I just pay the PCN promptly at the reduced rate of £60? img20240424_23142631.pdf
    • What you have uploaded is a letter with daft empty threats from third-party paper tigers.  Just ignore it. What we need to see is the original invoice you received last October or November.
    • Thanks for posting the CPR contents. i do wish you hadn't blanked out the dates and times since at times they can be relevant . Can you please repost including times and dates. They say that they sent a copy of  the original  PCN that they sent to the Hirer  along with your hire agreement documents. Did you receive them and if so can you please upload the original PCN without erasing dates and times. If they did include  all the paperwork they said, then that PCN is pretty near compliant except for their error with the discount time. In the Act it isn't actually specified but to offer a discount for 14 days from the OFFENCE is a joke. the offence occurred probably a couple of months prior to you receiving your Notice to Hirer.  Also the words in parentheses n the Act have been missed off. Section 14 [5][c] (c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid; Though it states "if any applicable ...." as opposed to "if all applicable......" in Section 8 or 9. Maybe the Site could explain what the difference between the two terms mean if there is a difference. Also on your claim form they keeper referring to you as the driver or the keeper.  You are the Hirer and only the Hirer is responsible for the charge EVEN IF THEY WEREN'T THE DRIVER. So they cannot pursue the driver and nowhere in the Hirer section of the Act is the hirer ever named as the keeper so NPC are pursuing the wrong person.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

everything looks normal on the court front - they have defended - then 2-3 weeks later you get the transfer to a local court and usually a copy of their defence as well.

then another 2-3 weeks you'll hear from your local court telling you how they want to proceed and what's required.

so, i think you are fine. i would ask if you ever sent a copy of your schedule of charges to both the court (send them now to the local court if you haven't sent them to the northampton court) and a copy to dg if you haven't already.

 

had you read the faqs and step by steps carefully - you would have seen the charliedog is correct - you can claim ci or 8% but not both - it is up to the court which they will add - if you wanted ci - you needed to back it up with lots of additional material in your particulars - but hopefully the court/and dg will read your schedule and your particulars as either/or not and ... and in addition - the c.i. is getting harder and harder to get.... hopefully they will grant you the 8% with no bother.

also, i'd ring the court and ask if the aq fee is payable or not - some courts are asking for the fee even though they are dispensing with the aq - and sometimes they don't tell you - so, just r ing and ask if it is payable.

Like many others I suspect, I am waiting each day for the postie to come.

 

From the court on June 13th I recieved notice of allocation to the small track (hearing) with a court date of Sept 12th !!!

 

With this order as annexed here to ........

 

The claimant shall within 14 days of service of this order send to the defendant and to the court:- ..........

 

a schedule of charges

b a secure bundle

c a statement of evidence

d copies of decided cases

 

I sent off my bundle to DG and the courts (arrived on Monday 25th June)

 

The defendant shall within 14 dayds thereafter send to the clai,ant and to the courts a response to the claimants schedule, stating in respect of each item claimed.

 

a whether such charge is accepted to be a penalty, and if not why not

b...................

c...............

d................

e..................

f copies of decidec cases and other legal material.

 

So a lot of info for DG to supply to me and the courts. If I have my dates OK, I should receive this by next Wednesday 11th. I am a little surprised that nothing has arrived but wait and see time.

 

Now I need to prepare myself for events post next Wednesday. If I and the courts do not receive anything at all from DG, do I need to contact the courts or should I wait for the courts to contact me ?

 

Finaaly I assume the court date is only of interest if both parties supply the courts with the information requested ?

This is more or less the Order I received ... DG's time was up last week to submit their papers and, guess what, they've not sent in anything:rolleyes: Letter sent to judge to apply for judgement by default (see Michael Browne's A-Z) ... awaiting reply. Court date fixed for 1st August, can't see this happening now.icon7.gif

 

If no word from the judge by the end of the week, will 'phone the court to see what's happening.

 

Don't expect DG to reply ... how can they declare how they reach their exhorbitant charges? Don't think any bank has yet.

I figured that, after 42 days, they'd had plenty of time to submit something:rolleyes: Also, didn't want to get too near the court date, so sent a letter straight to the judge.icon7.gif

Yes I feel that you are right. Quite honestly they probably have no intention of doing anything at all until they have too. If I dont hear anything by next wednesday then I will write to the courts.

Hi All,

Looks to me like things have changed a little.

My MCOL claim lodged march,defended after 28 days, sometime early May got transfer to local court, couple weeks later court date July 11th. Heard nothing then 16 days before court date, sent bundle for 27th June. Full Offer sent 28th. Received it 3rd July. In Bank on 4th.

 

Now! If i have read above correctly, it Seems now when they are setting a court date, they are also using what is called a draft order or similar, asking for the full bundle from claimant (You) within 14 days of receipt of the Notice letter. then the defence (bank) gets 14 days after that to send its bundle..

This is obviously the court knowing that DG will not send their bundle, getting it moved very quickly and so will either result with strike out the defence after 28 days of setting date and so in effect moving or rather dispensing with the court date as settled long before then. :)

Or

You get your offer sometime between the 14 & 28 days as long as you submitted your bundle.

 

Downside is you need to know your stuff a bit earlier, bacause the wheels of justice have just moved into top gear.

In MHO it could bring time from filing claim to offer a lot quicker but you have to be prepared to learn and have bundle ready.

My Order stated 21 days to get my bundle in, then a FURTHER 21 days for DG to gets theirs in ... they obviously had no intention of submitting anything after that length of time. One hell of a wait though to find out:rolleyes: I suppose this might help the judge to come down in my favour through and strike out the claim, rather than issue another instruction (hopefully:rolleyes:).

 

My bundle was well prepared after a lot of research and help on this site and submitted in plenty of time.icon7.gif

Mine the same but 14 /28 days. No word from DG so I thinking towards asking for the striking out from my local court. I did indeed request the draft order while the case was being transfered.

 

You prob wont hear anything at all from DG.

Once you have submitted your bundle and the total 28 Days are up. Phone the court to ask if (LOL as if ) DG have submitted their bundle, just to confirm you understand. When they havent, you can apply for strikeout, but i think an offer would come before that time after you submitt your bundle. Just make sure what you put in it is correct or DG Could apply for it to be struck out.

Thanks CM. I was interested to see that mimi case which is similar to my own, where no offer at all has been made after time for DG to submit had passed. Incidently the courts and DG received my bundle over a week ago.

I've had one offer only (just after court proceedings began) ... nothing since and have contacted them only once with a nudge letter. All quiet for ages now and have not tried contacting them again. Bank is A&L by the way.

you will still have to wait till the 28 days are up to see what DG do. Then ring the court and when they tell you they have not filed bundle, ask them about asking to have defence struck out, hopefully they will be able to confirm that you can do that, considering how far away the court date is.

Just wondering what I should do if I get an offer from the bank whilst waiting to hear if the judge awards judgement by default. Suppose it largely depends on what the offer is, doubt if they'll offer the whole amount though. They've only made one offer to date and that was way back in mid April.
