Yes it does make you feel good once you are back in control and I'm glad you've done what you have as I know you'll feel better now.

 

A little tip which I have learned the hard way, if any of them does phone you up - usually at an unsociable hour like 9 or 10 in the evening so you will answer thinking its someone important :mad: remember to tell them to put it in writing as you will not discuss it on the phone, then put the phone down, and don't get into a discussion with them despite how hard they try to get you to.

 

Its difficult when you are a polite person yourself and you know they are the ones being awkward - its so tempting to argue with them. I've found this the hardest bit, but when you've taken a deep breath and put the phone down one time you'll find it easier after that.

I have to say that I was stupid to. I was so organised at one point that all my debts were 100% in my control. I'd even cleared some of my credit cards only to make it ten times worse later on. I started ignoring letters when I realised that I just couldn't keep up with all their minimum payments. So I dug my head in the sand and prayed it would just go away. We were getting about four phone calls a day and it was really embarrassing when visitors came over and we just sat there ignoring it

 

but last year I was taken to court by Abbey national and decided after speaking to an advisor that if I didn't sort it out soon I would lose everything so I found a debt management agency (after being rejected for loans) and they have helped amazingly but creditors still aren't happy and I'm still being chased a year on by a few. My problem is that I pay the management company £30 a month to deal with our creditors and still I'm the one dealing with it.

 

The letters have stopped but I still get phone calls which I can never answer because I'm at work and thats when they ring (doh).

 

My advise is: you unfortunately can't bury you're head in the sand forever because a giant bug will more than certainly come and bite you hard on the arse (haha). Abbey took me to court with only three missed payments. You probably need to seek some sort of financial advice.

 

I do feel a lot happier and more in control but its the last two creditors that are dragging behind that are doing my head in! The won't except our offer of a monthly payment even though its only about £2 down on what I was paying originally. I'm only 24 so I've learnt some hard lessons that I never want to repeat. If I don't have the money...I will defiantly not be spending it!

send all of the a CCA request, and use this forum to help you every step of the way, if you want more advice/help

hello everyone today i got 2 letters in the pose both from BUCHANAN CLARK + WELLS. ( ace cards and gifts catolog) the first letter is to tell me that they do not hold a copy of my credeit agreement at there ofice,as they are noy the creditors. they have returned my £1 postal order i sent them and have also wrote they are putting my account on hold.#

the second letter from them was posted to me the next day, which reads, "i can confirm that i have arranged for a copy of the invoice to be sent to you, this will be with you has soon as posiable."

invoice??? is this my agreement, and am i still in counting the 12 days plus 30 days when it can become defaulted. xx:confused:

Good news so far... they haven't got it. :)

It is their way of saying that they have "sent off" for it. Whether it turns up or not remains to be seen, but until/unless it does within the 12 working days... you can withhold payment.

Yes... the clock is still ticking for their non-compliance.

 

 

Keep everything that they send to you... including the returned PO.

hello everyone,today i recieved some letters in the post

the first one is from DEBT MANAGERS LTD they are now acting on behalf of littlewoods,i sent my cca letter to the debt collectors littlwoods was using last, called NDR, becouse i had only just recieved a statemant/letter from them,now they have changed debt collectors do i now have to send these new ones a cca letter?? ( i know for a fact i never signed a agreement with littlewoods)

the second letters are from LOWELL FINANCIAL (a debt they bought of capital one) the first letter is dated the 11th april,which is a final demand letter,it goes on to read, my account is now with the pre-litlgation department, i am to make them a offer of settlement or set up a monthly payment plan.

the second letter they have sent me was sent out the next day 12th april. this letter is to confirm they got my cca letter and are currently in the process of contacting the original lender (capital one) to get a copy of my agreemant.

i was just thinking to my self....

why dont the debt collectors already have this infomation (copies of agreement,when they buy these debt of these companys??

It looks like the NDR account has been sold on again :mad: .

 

You can either send a CCA request to Debt Managers Limited or, send the letter below.... (rec. delivery)

 

Dear Sir/Madam

 

Account No:

 

I do not acknowledge any debt to you or your client.

 

In a letter dated xx/xx/xx, I made a request for further information under the legislation contained within s.77-79 of the Consumer Credit Act 1974. To date, I have received no response from your client and therefore wish to inform you that I will not enter into any further communications with your company on this matter, unless and until my request is actioned.

 

I also wish to make it absolutely clear that personal callers will be viewed as trespassers and action will be taken, including but not limited to, police attendance.

hi there, nothing more yet,to report back,i only heard back from the one debt collector,i quite cant believe it,how no one els has not responded to the cca letter i sent them all. :cool::eek::confused: (not sure what to think of it myself) xx

Well done for fighting back. Ive just started doing the same. like you I had loads of debts (most the same as yours) and I couldnt afford to pay them so I stoped opening the mail and hid it away so I didnt have to be reminded of it. I stoped answearing my door unless I knew who was there for over a year as I was so scared. I even changed my telephone number twice. Now am pleased to say things are looking up. 90% of creditors are in default so am now just waiting for the 30 days to expire.

hi again, today i received a letter from CALL SERVE LIMITED, (acting for it reads on the letter for debt managers ltd-for my debt from a catalog called vertbaudet i owe £1925.776)

on the 4th this month i sent them a cca letter,and the letter about debt collectors are not to call at my house unless they have made a appointment with myself,or they will be seen to be trespassers,i sent them fisrt class recorded with a £1 postal order. i checked with royal mail and they did recieve this the next day.

CALL SERVE LIMITEDS letter reads i have been ignoring them and they are gonna instruct one of there local collectors to call round my house to get some form of payment from me. it then goes on to say they might go on to proceed with legal action for recovery through aylesbury county court (aylebury is where they are based)

they have a website should i contact them on there website and tell them about the cca letter i sent them. i know i sent the the letter correctly with my full name and address along with my reference number. at least i know they did recieved it.

when i went on to the recorded delivery website and typed in the code on the recorded delivery slip,it came up has recieved (5th april) and i printed a copy of it off. :confused: xxx

If it makes you feel better, you can send a letter (rec. delivery) to say something like :

 

Thank you for your letter of xx/xx/xx. However, a request for a Consumer Credit Agreement was received by you on xx/xx/xx and therefore, until you are able to comply with this request, no payments will be forthcoming.

 

Furthermore, in accordance with my letter of xx/xx/xx, any representatives that do call at my home without an appointment will be noted as being in defiance of my explicit instructions and reported to the the relevant authorities, including the police.

hello everyone, today i recieved a letter from LOWELL FINANCIAL (capital one) they have sent a copy of my agreement,which i had signed 16/11/01,

they have wrote we look forward to your proposals of re-payment with in the next seven days.

the debt if for £363.33 can i offer them £1 a month for now, untill my financial situation is better, becouse im a single mother to 3 very young children and get very little money.

if so shall i ring them to tell them this? xxx

Do not ring them up about anything. Everything must be in writing (rec. delivery)... and you are well within your rights to offer £1 a month if that's all you can afford. Take no notice if they reject the offer.... enclose a cheque anyway... because they may try and get you to default and then go for a CCJ on that basis. Making payments offers you some protection against this.

 

Before you do any of that though, please describe the "Agreement" that they have sent you. Does it contain the words "This a Credit Agreement regulated by the Consumer Credit Act, 1974 ?

yep as priorityone says.

pay them £1 PCM and keep doing it regardless of whatever they do.

this will go a very long way in your favour if they ever get you to court [or want too].

the judge will have a laughing fit at them, single mother 3 kids you want what a month for her ...and you've made her come to court!!

 

i would get a stock of postal orders, [which you can watch being cashed online] or send them a £1 stamp every month [tip here £1 stamps are cheaper!]

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Just come across this thread. michsienna, I think you should give more info about this 'Agreement' you've received. If you can type out most of what it says (without any of your personal details that might be on there, of course) then someone can check that it is what they say it is :)

hi everyone and thank you for replying. it is a agreement ,just above my signature it reads credit account agreement, credit agreement regulated by the consumer credit act 1974.

can some one tell me what you mean by paying £1 in stamps, forgive me if i sound real dumb but is this £1 postage stamps.

i wouldent real want to pay them by postal orders has these cost £1.45 each.
