Hi everyone!

Thought I would set up a thread for my mums claim!

 

We sent off the SAR letter and have now received info back.

The covering letter is a very bad photo copy with mum's name and account details, hand written on! Lol....maybe they are feeling the pinch eh! There is even black slodges in various places from numerous photocopying, lol.

 

Anyway, what they have sent...'details of charges going back to the date the account was opened, or 1st Sept 2001, whichever date is most recent.'

 

Next bit...'You may now wish to proceed with your claim for reimbursement of charges but, if you do feel you need further statements, this will take longer to access our archived data. Please let me know by returning this letter in the attached pre-paid envelope and I will order them for you.

Under the terms of the Data Protection Act, we are allowed up to 40 days to fulfil your request.

The fee of £10 for this service has been taken accordingly.'

 

The signature is a rough drawn circle, lol.

Now we have seven pages with about ten lines on each giving us the details.

Example:(fictitious dates!)

03/09/2002 CHG O/DRAFT INTEREST **

1/10/2001 CHG O/DRAFT USAGE FEE **

30/10/2001 CHG UNPAID D/D **

30/10/2001 CHG O/DRAFT EXCESS FEE **

30/10/2001 CHG ACCOUNT FEE **

 

Which of these can she claim back? Is it all of them apart from the account fee?

 

We want to be sure before we send off the prelim on Mon morn. Also, what interest if any, do we add to the total. I know we don't add the 8% at this point.

 

Any help would be greatly appreciated.

Hi

03/09/2002 CHG O/DRAFT INTEREST ** You can claim parts, not all, you would need to use one of the Advance spreadsheets in the library, it's quite tricky to work out. In my case I didn't bother claiming.

1/10/2001 CHG O/DRAFT USAGE FEE ** Yes

30/10/2001 CHG UNPAID D/D ** Yes

30/10/2001 CHG O/DRAFT EXCESS FEE ** Yes

30/10/2001 CHG ACCOUNT FEE ** No

 

You don't need to add any interest (unless you are claiming o/d interest, see my comments above) until you file the Court claim, then you can add the 8%.

It may be of help to register with lloyds on line banking service however this only goes back as 2002 - here you can view all your statements and will find out what all the charges were for and will help you work out what interest you can claim ( over draft usage fee)- sorry if your have received actual statements as you will already have this info ( some people have received only charge info)

Hi guys & thanks for the replys!

 

It is actually an old account of my mum'swhich is now closed.

I think the info we have had from them allready will suffice.

 

Thanks for the info on the O/DRAFT INTEREST, Barty. Yes I think we will leave that and just claim for the others. We can always add on the 8% if (when! lol) it gets to filing for court.

 

Thanks again guys. Will complete her schedule of charges tommorow after work so she can get it sent off. Do you think we should send the prelim to Swallow addy in the return envelope they sent?
