Hi All,

 

Didnt start a thread with my progress initially, am now up to the stage just before I send the LBA. Have today received a cheque from MBNA to cover all the charges, however I have been claiming contractual from start which this does not include.

Letter with cheque stated it was in full and final settlement - I intend to continue to get the interest also, so sending a letter off Monday to say I will accept offer only as partial settlement, but when, if at all, should I bank this cheque? If I do it before they have received my LBA, could this be seen as acceptance of the full and final offer?

Hi Jimbo, I too received a cheque from MBNA yesterday. I had only sent them SAR. They sent a list of my transactions with a letter stating that they were going to offer me £230 (approx 47% of the total charges charged) on Thursday and then I recceived the cheque yesterday. I banked the cheque (whether I have done right or wrong I don't know) and sent them my prelim letter together with my schedule of charges + contractual interest. I stated in my letter that I am accepting their offer as partial settlement and will continue to claim the balance. total charges + interest - payment received = balance due. Hopefully this was ok.
