Hi guys, sent preliminary off about 5 weeks, followed by LBA about 3 weeks ago. So far, we've had ONE letter back from them informing us that they're looking into the dispute, no partial offer nothing (think they may be busy in that department ;)), so ready to file MCOL. Can anybody advise as to the wording to put on the claim form please?

Claimant has accounts ******** & ********* with Defendant from ......conducted on their standard terms & conditions. Since 01/10/03 the defendant debited charges and interest in respect of purported breach of contract. Defendant is aware of all details as a list of charges has already been supplied, another copy will be sent. Claimant contends that (a) The charges

exceed the Defendant's losses caused by the

breaches; (b) The Term permitting the

Defendant to levy such charges is

unenforceable under the Unfair Terms in

Consumer Contracts Regulations 1999, Unfair

Contract Terms Act 1977 and at Common Law. Defendant has declined justification of charges despite repeated requests. Claimant is claiming (a) the return of £519 taken in charges over 4 years and (b) interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 01/10/03 to 10/04/07 of £83.30 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.12. Claimant is also claiming return of SAR fee of £10
