Just done a 'prelim' for my other half to Cap One ("Tish vs Cap One"), and wondered if the following which I put in my letter might help you with your 'homework' -

 

' , , , , ,I note from the ‘Intervention’ printouts that you have kindly supplied me with that all of these charges, with the exception of the 3 ‘Returned Cheque’ amounts, were ‘system generated’ fees, which therefore required no manual intervention. Therefore all you would be lawfully entitled to charge me for would be a few seconds (at most) of computer time. This could be fairly charged at £120 per HOUR, which rate includes hardware, software, setup, and operating costs. This demonstrates that a ‘fair’ charge for each of my defaults would be no more than 20 pence. If you dispute this calculation, please either supply me with the previously requested full breakdown of your costs incurred in managing the defaults upon my account, or pay me the full amount I am claiming.

I also ask you to refund the ‘Purchase Interest’ amounts charged to my account, calculated from the point in time when my account balance would have been zero at the end of each month had it not been for the previously levied fees. . . . . .'

 

 

I did a seperate spreadsheet for the PI - why not claim it back - if it hadn't been for the charges then wouldn't have been paying over 2% per month!!!

Lloyds TSB - £3.5k - Court claim issued, defence rec'd and AQ filed; Alloc'n hearing 7th Sept Claim stayed 29/8/07! (JimmyBoy vs Lloyds')

MBNA - over £1k for mis-sold PPI - WON - approx £1500(IpswichWitch vs MBNA . . .)

Received a letter from Capital One today (appears to be the norm that they issue) confirming that they are going to send a cheque within 14 days and they are paying the total amount. They have advised me to notify the courts, but I think I may wait and see the colour of their money first!!!!!!!!!!

Hi adamc6671, capital 1 are fairly good. just be patient and they will offer the full amount.

 

The cheque has been received, and once it has cleared a donation will be on it's way - the donation will be a sent shortly which is a combination of funds from capital 1 and Northern Rock since I received their cheque too. :)
