HI CAP 1 HAS OFFERED to pay the difference of all the charges so they charged £20...a time and have said they will change these to £12 so will refund the £8 per charge do i have to accept this or can i get all charge refunded ? havnt come across this before

You do not need to accept this. It is a myth that £12 is acceptable and Capital One are playing games with you.

 

A finding of penalty makes any contractual claim unenforceable in its entirety.

 

You should continue with your claim and then Capital One would only be able to counterclaim for their actual costs and would have to plead and prove each cost for each individual charge.

 

This retrospective changing of charges without prior consent cannot be enforced. Under their terms and conditions any change of terms can only be done after 30 days notice in writing.

 

Continue with your claim, you will receive 100% of it back.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received
