Hi All

 

 

A quick question.......... Nat west issued a claim against me last year (about sept or nov) for full payment of an alleged loan.

 

I defended and requested a true copy of the agreement under the CCA 1974 legislation etc.

 

We filed our respective AQ's and natwest wrote to me and the court issuing a Notice of discontinuance (No copy agreement can be found) court action terminated.

 

Yesterday, approx 5 months later, I recieve a post card from a debt collection agency that I am to pay the "debt" now contact us on etc etc etc.

 

Question: Is it fraud for a bank to sell an alleged debt, knowing it is not enforceable? I obviously have all the documentation confirming the above.

 

The DCA has paid money for something they have no chance in collecting.,

 

 

Any thoughts?

hi if you have the relevant document to prove that you have been disharge fromthe debt ( the notice of discontinuance) then you shoudn't be worried as as long you can prove that the debt it is not enforceable. i am not sure on this one. i hope someone else can help him on this one . bump .

Why not have some fun with the DCA?

Send them a £1 CCA 1974 Request, whilst NOT acknowledging any debt is owed by U to them.

Perhaps they will eventually learn that to 'Bulk Buy' debt is NOT profitable after all...lol...:)

hi all..i have just had the same thing with my mums natwest account... no credit agreement and ppi miselling.....failed to supply agreement in response to my cca request last october...admitted they had lost the agreement so we stopped paying them...balance outstanding was about ten grand....they put this to the debt collectors in feb this year....we responded to the dca with a sharp letter informing them of the full facts...they then wrote back apologising and informing us they were not aware of what had happened and that the paper work had been returned to nastywest..

"ALWAYS QUOTE ME AS BEING MISQUOTED" :D

Hi,

 

Now Just done the same thing last week.

 

Notice of discontinuance from Natwest last november for £28 grand. Yes 28.

 

Wrote a stiff letter to DCA, awaiting response .

 

 

Serves them right they (natwest) put me through hell for a year! Just too busy to mess about with Dca's but I might have some strong words to send to Natwest.
