As long as the ex-husband has not already put in a claim, your partner can make a claim for all of the charges.

The claim form N1 only requires one signature (your partner's). As far as i am aware, she need not refer to the account being a joint account on the claim form.

However she does need to be aware that if the bank settles out of court, it might require both your partner and her ex to sign acceptance of the settlement.

Hi,

 

Scenario:

 

Partner was married but now divorced. Had a joint account with husband now ex-husband of course...

 

Could she claim back charges from the account?

Hi, I have successfully claimed (twice) from a joint account, and only used one name and signature, without it affecting the outcome. I agree with Calculator and wouldn't mention the fact it was a joint account. does your partner still use the same surname?

Would there not be issues with DPA requests?

 

 

Furthermore, what if the other half stumbled across this process and tried to claim themself only to be told "actually your (ex)partner has already taken the lot"? All sorts of trouble could arise there.
