Hi folks, 1st post here.

 

just a quick query on reclaiming. I recieved my letter back from my bank saying "we think its fair, so no money for you, if i don't hear back from you by so-and-so date then i will consider the matter closed"

 

i returned a letter threatening small claims court. i have recieved no reply since, it has been about 3 weeks.

 

now, is it worth calling them up and chasing to see if they recievied any letter (it was sent "signed for")

 

or just go to small claims?

 

any help is most appreciated. Thanks

My temptataion would be that as you have told them that yiu will take them to the SMC then I would have the courtage of my convictions and carry out the threat.

 

Obviously this decision may be determined by the value of the charges that have been levied but as you have replied back to their origianl fob off letter and have no reply then I know what I would do.

Your current account status is irrelevant to your claim for contractural penalties to be returned. If you're £1500 o/d, it matters not a jot - they have unlawfully taken your money and MUST return it.
