Hi All,


FD offered me part settlement on the 14th day after my request for repayment (2nd letter) and I sent them an LBA and also refused their offer. Its been about 20 days now and Ive heard nothing. I have my County Court claim form filled in and ready to go. Only two things I didnt send the LBA recorded and does the LBA need to say "without prejudice" on it as someone on the forum has mentioned? Should I call/write to them to see whats happening or just issue the claim? It seems they are trying to call my bluff. Not that it is a bluff but could without spending the £80 court costs but will if I have to.

You don't need to worry about the LBA if they haven't made a sensible offer then now is the time to move onto the court action. Keep to your timescales and once your court papers are filed then FD have to take notice of your complaint. :D
