Hi All - I 'joined' yesterday

 

Currently about £4,000 over my agreed overdraft limit with NatWest and as I am not able to reduce this amount at this time - NatWest are threatening ‘further action’. Though they have not responded (other than standard letters) to my Income and Expenditure breakdown (first sent on 24 February) or my list of creditors. As I understand it my 'case' is being dealt with by the CMS Department (whoever they are) - though I've not heard from them as yet.

 

Given I owe NatWest money at the moment (O/D approx 11k ) – would it be sensible to make a claim against them for excessive charging, or would that just compound my ‘problems’. :confused: I have opened a parachute account with HBOS :-)

 

Any advice or thoughts from any one with similar experiences would be most welcome!

Be calm and delay no more. It is time to fire off your first letter called SAR (Subject Access Request) under the Data Protection Act 1998.

 

The money you owe them may be made up of unlawful charges. They cannot enforce it in court. They may even owe you after all!

 

Make sure you use the letters in the library. Link below:

The issue here is not the fact that you are over your o/d limit by £4k-it is the fact that the charges levied by the banks are not a level that reflects the actual cost to the banks.

 

As such if I was you I would at least take the first step and request copy statements for your account going back six years.

You might be amazed at how much it reduces your debt with them - you never know it might even clear it. Get your statements and add it all up and I'm sure you'll be amazed at how much of the 11k is really just charges

Get moving on this quickly because the sooner you can let them know your account is in dispute then they cant start chasing and threatening until the dispute it sorted out first. Act as quickly as possible because it sounds like theyre getting itchy feet already. All the best. Fendy xxxx

Thanks to all (once again) - Slightly confused as to whom/where I should send the SAR letter to :confused:

 

According to the Information Commissioners Public Register it should be to 135 Bishopsgate, EC2 - or am I just being a plonker ?

 

So is it Bishopsgate or Edinburgh or Borehamwood ??? :confused:

This letter will simply put them on the alert that the account is in dispute so that they don't try to place default in your credit file if they have not already done so. This letter is your reply to their letter threatening 'further action'.

 

You can then press on with your SAR letter and other subsequent letters. You MUST send off your SAR letter now. If you send both letters the same day, no problem. Preferably in separate envelopes RECORDED.
