Hi all,

 

Cap one took £420 in charges over 2 years.

I sent off the form and got a reply stating

'Goodwill offer of £160 - Charges droped from £20 - £12

 

Has anyone else had this - Do I take it or carry on with the 2nd Letter then the MCOL?

 

I have heard Cap 1 can get funny - Last thing I want to do is go to court.

This is standard for credit card firms to make an offer of the difference between the charges applied and the new limit of £12 under the OFT ruling. I had exactly the same with Cap One, you should reject the offer using on of the letters then proceed with you LBA.

You wont end up going to court, they will settle long before then. With my claim against Cap One I filed through MCOL and recieved my settlement before the AQ's were returned. Stick to your guns Louise and hold out for the full ammount as it's all yours, plus there's the added bonus of being able to apply the 8% interest under s69 of the county courts act once you get to the stage of filing your claim, this will increase the inevitable settlement you recieve.

This is £424 in charges in full. I didnt add the 8% in my first letter to them.

I also, cant work out the 8% - Not very good with maths or tables to work out.

 

I will reject there offer.

Hi for 8% interest use the simple spreadsheet from templates library but be prepared for crap1 to drag there feet. Keep going you will get your money

If you enter all the charge details into one of the spreadsheets it will calculate the 8% interest for you. You can't reclaim the 8% mind until you actually file your claim through the court.

The only problem now is - I sent the papers with the charges back to them as they ask for it. And no i didnt get photo copys.

Oh well :)
