My question there is really what might constitute proof? Since you say the issue of delivery is a common one I suppose that no satisfactory answer has been established or you would probably have told me.
    • I would stand your ground and go for the interest. Even if the interest is not awarded you will get the judgement and the worst that might happen is that you won't get your claim fee.  However, it is almost inevitable that you will get the interest.  It is correct that it is at the discretion of the judge but the discretion is almost always exercised in favour of the claimant in these cases.  I think you should stand your ground and don't give even the slightest penny away Another judgement against them on this issue would be very bad for them and they would be really stupid to risk it but if they did, it would cost them far more than the interest they are trying to save which they will most likely have to pay anyway
    • Yep, true to form, they are happy to just save a couple of quid... They invariably lose in court, so to them, that's a win. 😅
    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...  
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I've prepared nearly all the stuff i need to send off to court. I've prepared the court bundle and most of the additional information/evidence. What i need to know is - The Commission Report (which it's been advised to include as additional evidence) is 198 pages long. Do I have to print off all of these pages (3 times)? and am i even looking at the correct report?

 

I want to get my stuff sent off a.s.a.p so any help is really appreciated.

I really dont want to be a pest but,

What exactly do you have in your bundle as i am having trouble with mine. What i have is the charges, interest spreadsheet and the letters i sent them, and i have the evidence sheet which i have deleted the part about phone calls. Have i done right?

Would need to have a look when i get home but i think its all your correspondence with the bank, copies of statemements, schedule of charges, OFT report, SOGA (sale of goods acts), 2 other acts which i cant remember the exact names of and evidence to back up your claim.

sorry but i must be really thick what is an oft report and these other acts i should obtainl. i looked at the basic court bundle later stages and printed it off is that one of the things i have to photocopy 3 times and send off or do i alter it first i really dont know HELP!!

Hi

 

If you read the two threads thoroughly then they will explain exactly what you need to include in the court bundle and the additional information that you need.

 

The 3 copies are one for the court, one for the solicitors dealing for your bank and one for yourself.

 

The OFT report is the Office of Fair Trading and the report is about the charges imposed by credit card companies. The other Acts are all included in the court bundle link in a .zip file.

Hi

 

Just to let you know i'm in court on 19th April at 11.00 a.m. and Lloyds have still not settled.

 

I don't expect them to settle until either tomorrow night or Thursday morning. I'll check later on again today and then on Wednesday. If no settlement then it looks like I have to prepare myself for court. To be honest i've not let it worry me as i've never heard of anybody else actually having to go to court BUT i don't want to be the first!!

 

I've had absolutely no communication from their solicitors since i got the court date about 2 or 3 months ago!!

 

When do I apply for costs for taking time off work and preparing the court bundle. Can i claim my hourly rate at work?

 

I'll keep you posted as to what is happening

Sorry I haven't seen your thread before, but good luck on Thursday in court. Can I ask if you prepared a court bundle and if you sent it to both the court and Lloyds solicitors (are they SC&M?).

 

My understanding on costs, as a litigant in person, is that you can claim your costs (at a set hourly rate of £9.25) for travelling to and attending the court hearing up to, I believe, a maximum of £50. Your other costs (assuming your claim is in the small claims track) are not claimable unless you can persuade the Judge that the defendant has acted unreasonably. There have been instances where other claimants on this site have been successful and some where they have not.

 

May I ask which Court you are dealing with?

Yes i prepared a court bundle which was hand delivered to the court and sent recorded delivery to SC&M. Like i said in my previous post - I have had no communications from them.

GaryH has prepared a letter for claiming costs where the defendant has acted in an unreasonable manner i.e. taking everything to the last minute and generally acting like a t*t. It can be found here Application for costs

Hi j.wandless I just wanted to wish you luck with your court hearing tomorrow. I got my court hearing letter through today, my claim is with the oh so nice Llyods!!!! Hearing is on the 20th June a little way away yet still in process of looking on site to get my Bundle together. Are you actually going to the Court or just sending your paperwork in?? Best of Luck will be waiting to see how you get on. Suz

As Nic said, you'll more than likely get settled tomorrow morning, or, you may turn up in court to find that they have faxed them indicating an intention to settle. In which case you should request a 14 day adjournment.

Presumably there's nothing so far from LTSB/SC&M?

 

I can imagine that you're probably a little unsure about this morning but the important thing to remember is that you're not alone in all this - many of us will be at the same stage I am sure.

 

IF they do turn up at the hearing you are very well prepared to argue your case. For them to defend it they will not only need to explain to the Judge why they have not complied with the directions of the court, but (more importantly) they will have to show how they have calculated the charges if they continue to say they are a fair charge for services provided.

 

I can't wait to see what happens!
