hi just about to enter my mcol was just wondering if i should enter the address.

HSBC Bank Plc

Canada Square

London

E14 5HQ

 

also do I need to print anything off when i do the mcol because my printer is not working.

Hiya Tanner, yes the Cannada Square address is the one to use on MCOL. You dont need to print anything but it might be useful if you save your spreadsheet under a different name (save as) and disable the calculations by copying the whole sheet and pasting back as value only (both commands under edit) just so you have a record of what you have sent into the court.

not due to enter it until friday just getting ready thanks for your help. once I have entered the claim do I need to send a copy of my charges to the court and if so will the mcol give me their address sorry for all the questions.

Once you have filed your claim, you need to send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

Northampton County Court

Dear Sir/Madam

 

(Your Name) –v- (Bank)

Claim No: ********

Date Issued: xx/xx/xx

 

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

 

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim. dg's address is on page 2 of the acknowl.

I understand you have a policy of initially rejecting claims for overdraft interest. It only ever relates to the cumulative charges within the overdrawn balance of the account at the point that the overdraft interest was debited

 

If it is that in your view the interest is not claimable, I am prepared to discuss this with yourseves and the judge in court.

No because that will compound the interest, the 8% statutory interest is not a compounded figure so its a straight 8% over the time period of your claim therefore the daily interest from MCOL should be just on your charges and overdraft interest.
