hi all iam new to this site and registered today ....

 

my question is what do i next .i sent letter to barclays waited 14 days then they offered me 525.00 in gestureof goodwill which i think is a bit pathatic ..want to pursue for more ..but not sure of what letter to write. shoudl i pass on to one of these companies that charge 30% on refund bank.

I strongly advise against you using a firm that charges you 30% when you can do it all on this site for free.

which letter did you send the Prelim? if so you need to send the LBA.

really -why is that professionals at it and more experiaince.

ive not got money at mo to threaten court action but yes i ll have a look on here and see whats what.ill going to sent refusal letter whichi think will delay it another 14 days ,then a another offer then court if offer not acceptable

ok here we go let the battle commence ..this site is reallly good and its nice to know that there are others in the same boat ..

 

 

anyways this is what ive done so far ...

 

sent letter of to barlclays an estimate of charges based on three months which i worked out to be 4788.00 wow big money.. sent letter off on 22 feb .received letter within 14 days say yeh yeh sorry u are unhappy but are looking into ur complain .we willl reply with in 14days

 

they did and offered me the full and final settlement of 525.00 as gestureof goodwill .ok its nice but not enough.

 

i sent rejection letter 4 which i found on here to them on 24 march

waiting fro reply

Confused to how youve got this far without submitting your SAR?

 

Anyway, if you do, send your £10, you will get it back, Barclays dont charge [most of the time]

I think you should send a DPA SAR and find out exactly what your charges are. If this ever gets to court, the onus is on you to substantiate your claim, which at the moment you clearly can't. Barclays only have to say what charges, how much and when and you're stymied.

so are you saying you have been charged 2 x £30 EVERY month for 12 months?

 

you will need to find out how you reached your interest figure, all calculations must be proved if questioned otherwise they will look like you have made a figure up in your head.

 

Realistically, I think you are going to have to submit your SAR and start from there..

the sar is the very first letter you send to request all statements for the last six years.

 

from personal experince in the last 12 months i was charged £395 but in the previous five years to that the total was £230, as you can see one in one year i totalled a lot more in charges than the other five put togeter, just because the last three months you have received a lot of charges does not mean that you have been for the past six years!!!

 

If this were to reach court stage you would need to detail each charge, barclays bank and certianly no judge will take this claim seriously on estimates alone.

 

I know it feels like it adding to the whole timescale of the process but i believ it is an important step that you should not miss out especially if you want to be sucessfull.

right .ive sent my lba letter to barclays on the 21 march 14 days and times up .now what ..

 

i know ive messed it up abit by not getting statements of bank first so i

sent a dpa letter (3april 2007) to bank along with 10.00 which is what i should of done in the first place ..

will the new dpa letter affect preivous Request for repayment of charges

ok iam reading into this statory interest and something seems confusing ... its 8% but is that on the whole amount claimed for the past 6 years at 0.00022 then another 8% from date of prem letter to date of claim then up to claim.....

 

if iam owed 3000. is it 0.00022*3000

=0.66 p a day interest 6years would be 365*6=2190

2190days *0.66 daily interest =1445.40 surely thats wrong ...

 

 

then 0.66 * days till court hear say 4 weeks from date of lba

0.66*28days =18.48

so total would 3000+1445.4+18.48

4463.88

It surely is. The statutory interest is calculated on each individual charge from the date of that charge till the date of filing. It's impossible to work it out from just a total of your charges, which is why you need your statements.

i was thinking that u calulate 8% on 3000 which includes (referral fees and overdraft interest ) .togeteher .seems to me that u calulate 8% on referral fees, then 8% on overdraft interest then add two togther for one total .???

Have you entered your charges into the spreadsheet from this site?

This will automatically calculate the interest on a daily basis up to the date of your settlement..
