    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver I could initiate a claim. Or much quicker  - the other entity - with a charge already - could use that to make an application for an order for sale.
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.
    • This other entity doesn't know what's going on.  To be clear I had huge equity.  No-one would ever expect a lender to erode all my equity.  The question is - if anyone knows the legal answer - on the basis they have a charging order - could they make an application for an order for sale?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received copies of 3 loan agreements and 1 credit card agreement from Egg today. Just the agreements, one of which I don't recognise and know I didn't sign....

All of these are listed with experian as settled....

the one they cannot supply the CCA for is the one they are still asking me to pay.

They started this loan, No agreement and are trying to enforce it.....lol

They never even gave me the loan amount they say i owe them....lol

They have had me thinking I am still paying one of the settled loans.....

Am I correct in saying I can ask for all my payments back for this loan if they cannot prove it ever existed??

As there was never an agreement??

Also were they supposed to send terms and conditions and statement showing what is still owed??

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I was going to send a notice to them letting them know they may have committed a criminal offence....and that it is being reported to trading standards, OFT and the FSA...

I was just trying to find out under what legality, I could ask for all the money paid to them so far, back!

They have listed that I have paid them £4400 back on a loan that I never signed an agreement for.....

I just want to use the law the same way they have done to me to stitch me up....

If they cannot enforce an agreement because they don't have one, what legality allows me to ask for the money back????

Had a few more things happen since I last posted....lol

Moorcroft have started threatening me again by phone, letter.....

They even swore at me again on the phone and failed to tell me who they were when they called me....

After calling EGG by phone I have informed them of their failure to fullfill my CCA request....

The nice peron I spoke to is for the first time actually looking into my complaint personally....

They have put a muzzle on Moorcroft until 30th June....

Today I received a copy of a Credit agreement with incorrect details on it as EGG refunded the PPI....the total amount to be repayed is incorrect as well as the interest rate is wrong....lol

I also received a statement of account.....but the figures are incorrect....lol

It appears EGG staff cannot add or subtract properly.....lol

Instead of applying my payments from the balance of account they added them to the amount owing.....effectively making what I owe greater.....lol

Yet more ammunition for a court case......lol

You should write to moorcroft and explain that you want all correspondence in writing from now on - they have to comply.

 

Also, point them in the direction of the OFT's guide;ines for debt collection which states, clearly, that they must introduce themselves in all correspondence.

 

Ok, so Egg have commited an offence - report them to Trading Standards and take them to court.

I am going to report them.....but giving the lady at EGG till 30th to resolve my complaint about the PPI and loan first....

If she can get it all dropped all I will have to do is prove the failure to supply CCA and SAR's.....

If it comes to nothing then I can still use the CCA, mis-selling, false statement of account, SAR's, Harassment, etc....to go ahead in court....lol

I am just giving her a chance to put things right prior to court action.....should make any judge look at me as bending over backward to get this sorted out prior to court.....lol

Just quickly popped back to let you know what happened.....

EGG have sent confirmation letter that they will NO longer be recovering the debt.....

They are cleaning my CRA files and listing the loan as settled with a zero balance....

They appologised on the phone for the way I was treated.....

And are dealing with Moorcroft.....lol

So I won.......lol

They wiped out the £4709 they said I owed..........

Persistance paid off.....lol

Don't give up un1boy......Thanx for all the help.....

I have moved with fendy....so not about much......lol

I think I was lucky.....I found someone at EGG who listened and actually realised I had their b*lls on a platter....lol

Mis-selling PPI and loan, breach of contract, CCA not supplied causing offence, SAR's not supplied and lying to the financial ombudsman......lol

Oh and Nastywest decided to settle on the same day......lol

So got a double whammy......lol

keep your chin up.

 

just one last point

 

settled on a CRA is almost as bad as a default marker.

it CAN be read as 'you did something wrong along the line, then paid-up later'.

i would get back on to egg and get them to remove ALL ref to the loan COMPLETELY from the CRA listing.
