Not that they've done anything about Menzies yet but he sounds like a blackmail risk. The MP, who is one of Rishi Sunak’s trade envoys, is also said to have called his 78-year-old former campaign manager at 3.15am one day in December, claiming he was locked in a flat and needed £5,000 as a matter of “life and death”.   Hes supposed to use funding from Taxpayers and doners for a life of service, not funding a life of drink and debauchery Hope his parliamentary expenses are also investigated.   In fact, perhaps Mr Bates next role in life should be as an independent investigator of Parliamentary expenses?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Boris, Good luck with your claim. I'm subscring to your thread now. You're a little way ahead of me, but I am curious to see how dirty Abbey can fight when the stakes are raised somewhat. We're both in the XXL category in terms of our claims, I guess.

HI!

anyone there?? i understand whats going on now...your all prbably really busy! i have been contacted this moring by Southern Counties radio station before regarding my claim and charges. they have asked me to be on the radio live this afternoon at drive time, going to plug CAG, they want my opinion and views on the current circumstances with the OFT, and how this affecting me and my claim. Would anyone like to have any input that they feel might help...if so please PM me A.S.A.P. i have done my homework i understand the circumstances and am watching the news closely today.....open to views and opinions!

No, I don't think your claim will be stayed as its at such an advanced stage - and in fact its not even clear if the courts will stay claims at all yet, although it stands to reason that some, if not most, will. If yours is stayed then we'll file for a set-aside.

Oh my Goodness, I am so stressed about this, The Radio programme went fine, they asked me how it effected my case and my opinions. I said I would never of got this far without CAG, and that it is full of wonderfull , helpfull people and gave a good plug, It was on drive time on southern counties radio, Anyway, I am not dealing with this very well its making me wobble a lot, I could smell the money, They have said they will make no further offers as things stand. I assumed thro reading the papers ,financial mail, today that I now have to wait ,same as everyone easle,I will post my bundle as per order still, lets not fall for that one! Will the judge still hear my case, and why if they dont can we apply to have it set aside? I am so confused and desperate. Sounds pathetic I know.:mad:

Don't worry - its unlikely it'll be stayed at this late stage. Even if it is stayed then we'll apply to have it set-aside (lifted). Just file your bundle on time, proceed as normal and wait to hear from the court.:)

The blanket suspension on any complaints only applies to the banks internal complaints procedure and claims going through the FOS.

 

It is entirely at the discretion of each court whether or not to stay any claims already in the court system. As yours is at a late stage, IMO its unlikely that the court would stay your case. If Abbey apply for a stay then we'll oppose it.

Gary, think i have finaly got my bundle together. should i g through this with you before sending it of. Still heard nothing from the court, so i presume its still on, will be back online this evening. hope your okay, are there any other changes i need to know about?

Hi my bundles need to be in by tuesday latest. I called the courts and my file was with the judge. They called me back in the p.m. and told me that the judge has said the case is to go ahead. Abbey have not yet applied for stay tho, I am nown awaiting that!! Good news tho what do you think ????
