    • I received a letter this morning from advantis acting on behalf of HMRC for a tax credit overpayment.. I am going to call them on Monday to set up a payment plan but am worried sick it’s going to show up on my credit file.. does anyone know if it will show now that hmrc are using them? 
    • I'm going to check the measurement units today as I feel this could well be happening otherwise I can't understand how the bill can be so high even when nobody there living sometimes. 
    • Totally stupid mistake struggling with money with 2 young kids no excuses so I won't bother justifying  just feeling deep regret and absolute fear for what happens next. Sincere moments of madness opportunistic and absolutely stupid Caught shoplifting from sainburies by and shop lifting plain clothed detective (penut butter almond milk chia seeds and nuts ) I only took 3 to 4 items from sainbries listed above  First time I did it In saisburies i have never done it before   Was given a letter banning me took details but no photo taken  I also had on me food items from mns that the store detianed at the same time as they wouldn't let me leave without showing a receipt as they said I would have stole those too (they werent wrong) . I have been to mns a few times in the last month and done a similar thing always general food shop  So I left the sainbries store when he let me go and left all the goods there mns.and sainsburies and did not return.  M&s and sainsbries are on the same high street   Questions  Was not caught by m&s will sainsburies share my info and will m&s be in touch? Presume they can check cctv of the time sainsburies detained me and probably find it  No police called when at sainburies  Scared that mns will also ban me after the event  or worse check cctv and have my details and pass to police to investigate  I am mortified at what I've done the detective did not mention anything about further letters / police or anything more other than taking my details and giving me a banning letter  My fear is they have told MNS and now MNS will investigate aswell they may have their own footage etc...and go further than sainsburies did at that time  Mns goods was fruit veg chicken cheese basically all food items  Advise please what could I be facing 😭

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a note to encourage all MBNA claimees to carry on fighting!

 

I am currently waiting for a cheque for £900 which is everything I am owed by MBNA. A really helpful guy called Gareth sorted my claim out for me, its all been agreed, just waiting for cheque in post.

 

Good luck to everyone else.

 

(Now still waiting for two more claims with Halifax, waiting for court dates!)

To be honest it was so easy! I am amazed. I did have several conversations over the phone but I mainly just answered yes and no as I was so scared of messing it up! if you need any help, let me know.

I too have just had an offer from the very same man at MBNA. This was after them receiving both the letters and sending me three fob off replies saying they will send a response by x/x/z and never doing so. After issuing the claim on the moneyclaim website, they ring me up with the offer when they have just two days left to file their response/acknowledgement. Just gotta get the amount ammended as they have added yet more charges and interest since the phonecall.

 

Guess they thought they'd play the game with me but changed their minds.

 

Does make me wonder why they even bother having customer satisfaction representatives as they call them as nothing ever seems to happen till it goes to the customer advocates.

I also have had it confirmed that MBNA are crediting back 800 pounds and cleared my account after all the ussual letters stating how right they are Blah Blah Blah. However as a goodwill gesture we will give you a refund of 350 pounds. I then phoned and told them that as well as my 800 pounds iwould be claiming back my 39 pounds court fees. Their response was that they didnt want to goto court and if they settled in full plus interest @8% would i put it in writing that i wouldnt go to court which i was happy to do. Their guy Gareth Tuncliff (customer advocat Svs) was very helpful
