    • No you don't have to pay them.  it is their scam which the Courts know about. There was a classic case a few years ago that decided that £100 was not a penalty because that company had a legitimate interest in keeping the car park clear of cars that overstayed etc because they were there to maximise the availability of car park spaces. As Starbucks was closed in your case, Met have no legitimate interest so their £100 charge IS a penalty. Therefore the case would be thrown out. if they took you to Court and you turned up in Court to defend yourself. So no you shouldn't pay.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I just wanted to say have just finished typing my prelim letter to halifax, it is late so will be off to the post box in the morning.

I have been reading everyones threads for the past week and you have all inspired me to ask for my charges refunding.

It's only small compared to some peoples but am starting off:)

 

I was in my local branch today the man there is lovely. When I asked for address details for halifax he was intrigued to know why. I told him and he said he would be very interested to hear of my outcome so that he could tell other customers how to go about asking for their charges back! Am going in tomorrow with full details of the website. How cool would that be if he had your details on his counter!!:cool:

Bloomin heck it took me ages to find my original post....... should have bookmarked it...........anyway just to update............

 

I had a reply to my prelim request with a goodwill gesture offer of £60, which I accepted as part payment towards the total claimed for within my LBA. Needless to say I haven't heard from them since. I gave them an extra week to reply( just in case, wishful thinking:roll:) and just filed with moneyclaim last night. Looking forward to receiving a refund forthwith!

 

Am forever encouraged by this fantastic site..... also my brother just received a full refund from halifax last week for £1800.:grin: He was very happy.

Hi all,

 

Mysteriously two deposits show in my account today, arrived there some time wednesday afternoon.... Yay!!

One a refund of court costs and interest the other the refund.

Went to get a printout from the bank.... really satisfying....they were as pleased as I was.:D

 

Just wanted to keep you updated.

Do you have your own thread somewhere? I can't seem to find it, we need to know what stage you are up to then people can offer you advice. Yes I did have to issue court proceedings via moneyclaim website but that was after the letter writing had failed. Have you read around to make sure you know what you are about to undertake? Start your own thread and then we can help you.

Hi Milvertons,

 

Yes I used the template preliminary approach for repayment letter,in the bank templates library. After all thats what they are there for;)

 

I removed the section highlighted in red as in this case it wasn't relevant to me.

No I didn't include interest on the money as it was a small amount I was claiming for. I have posted on your thread re interest that may be confusing you.

 

Stick to your timetable, your money will be refunded. Remember there are lots of people who have been through this so we are here if you need help.

HI congrats on your result. I am claiming for OH, they have replied offering £58 what letter do i send saying that i will accept this as part payment? As i am a little unsure I have read through and confused if i start of my money claim or send of a letter. Any info would be much appreciated.

Am not sure what stage you are at, any chance you have your own thread somewhere then we can see where you are up to? then advice can be given knowing all the facts.

 

In my case I just adapted the letter before action template letter to include the following,

Dear person from the halifax,

Thank you for your letter dated xxxx, I appreciate the speed in which you have responded to my letter of xxxx. I accept your goodwill gesture offer of £xxx and i am willing to accept this as an interim payment only, not as full and final settlement.

I understand that the charges you have been applying to my account in relation to unauthorised overgarft fees etc etc then rest of template letter.
