      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just about to send my SAR but have moved house (twice) since I had my account with the crap1 and wandered if anyone knew what proof of I.D. they requested (if any) so I could send it with the SAR.

We telephoned them and did a change of address. That was all that we needed to do to get our SAR sent to us.

 

If they don't accept that, a copy of a recent utility bill in your name and new address is more than adequate.

woolwich refused to accept my letter instruction of new address (even though they did carry out the other instructions in the letter to cancel a DD!). I rang and they said they hold signatures on file and can match them up with letters which is why they had taken my instruction on part of the letter ....erm, and. However the limp excuse for them not recognising my new address was "money laundering policy". They reckon I have to go into a nearest branch with photo ID to get my new address lodged.

 

Well, since I have a severely disabled partner who I care for 24/7 and there is only one branch in nearest city that would cost me an arm and a leg to park in, I am livid.

 

Fortunately, my friends live at my last address (registered with bank) so I am still able to conduct the first stages of correspondence. I will be writing again to Woolies demanding they take my instruction or I will complain to the disablity rights commission.

 

I even offered them sight of my Inland Revenue, alternate bank and utility bill letters showing my new address but apparently what's good enough for the HMRCS just isn't secure enough for my rotten bank.

Well, my word, recieved my copy statements and manual intervention screenshots this morning by recorded delivery!!!! It was a surprise as I expected a bit of a fight, me being at a different address and all. Done the highlighter thing but am concerned/confused. In may and June 2002 I have 3 entries on the same day each month "Late fee refund - £18" A few points about this.

 

1. I dont remember asking for these refunds (thats not unusual) but why would they do this off their own back

2. Why are they all on the same day, is it just 1 charge refunded 3 times or 3 chrges refunded

3. If I do have to remove 6 charges from my SOC's which ones do I remove as there is no reference on the "refund" as to which charge it applied to.

 

Strangely enough I don't trust these bleeders and would welcome any input.

OK, So charges come to £315 without interest. £467 with 8%. I've been reading a lot of bank threads as I have a claim with lloyds. Been thinking about going for contractual with c/cards but read this week that banks were starting to defend contractual interest,

is it different for credit cards?

has the principle been tested?

If I decide to go for contractual what's the best spreadsheet. I'm not good with them so the easier the better.

OK, decided against contractual interest. Was happy with the arguments for, but don't think I could argue it in court against a barrister so just going for standard 8%. Rennovating a hpuse at the moment so this could be my new bathroom!!! Posted prelim today. 14days to LBA.

I would go for Contractual Compounded Interest. They have charged you this on each charge. Works both ways, and they have been paying it. You probably won't go to court, they have'nt yet over charges..

My issue with doing this is that

1. This is an old/closed account and the charges date 2000-2001 so it will be my first one over the 6 year limitation. Kind of worried about that as this is still new territory (but not for long I feel)

2. It's only a small claim (approx £350+ interest) CCI at 34.94% brings it to almost £2500 but at the authorised borrowing rate 18%ish it drops to £800 including interest. £500 with 8%. I've seen a couple of threads where Cap1 state they only charged on charges at authorised rates.

 

If I'm honest this is more of a toe dipping exercise as I wanted to test a pre 6 year case myself, before having a pop at what will be a very large LTSB claim on a current account. If i'm gonna cock it up, i'd rather do it with a £500 claim than a £7K one and as I said before, worst case scenario, I get a new bathroom suite!!

After some thought and reading have decided to go for CCI on this and Barclaycard. It's nearly doubled the amount of my claim which is great news. Sending a further LBA ASAP(tuesday?) for new amount of £888.34 and counting. I used 17.85% as the rate. Found this on the manual intervention forms that came with my charges list. It said they posted a letter telling me this was my new rate. Have given them till 6th june to reply.

From my knowledge of Capital One claims they do tend to submit their defence and then settle very quickly afterwards, I tink the end is sight now!!

Cheers Trish, Recieved acknowledgement today. Will be interesting to see how long it takes to get the money. If they run true to form I should get a settlement letter in a couple of weeks. I got a default judgement against LTSB 4th may and still have no cash:eek: Looks like these clowns are gonna pay first and I only filed against them 6th june.

Hello all

Recieved my first letter ever from Cap1 since I closed my account. It said words to the effect of "we're not wrong but the cheques in the post" So that's it, 3rd claim won. Just hope this cheque doesn't bounce like the one from Lloyds did!
