The Halifax have charged me again £39 for a failed DD, I had loads of charges about 3 years ago had to borrow money to get the account straight again and have had no charges for the last 2 years.

 

This time with the help from others on the forum I'm fighting back for this set of charges and the ones from years gone by.

Welcome.

 

First and foremost, before you start please have a thorough read of the FAQs. This is a must, no excuses. There’s a Step by Step guide here too. You should print these out to refer to later, so as to avoid having to ask basic questions.

 

You need to spend 2 or 3 days gradually getting your head round everything.. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily. Here’s one to start with, which you should find useful later:

There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time

 

This is a self-help forum and you must be prepared to put in the time and effort required. It’s your claim, your money and you cannot expect others to do all the work for you.

 

Then look at other threads in your bank’s forum, so as you know what you can expect to happen. At the top of each bank’s forum is a Successes forum where you can follow previous claims against your bank from start to finish.

 

When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help. Always stick to one thread, so people can see what you’ve done so far and therefore can give you better advice.

Finally the Moderators and Site Helpers are having to spend far too much time dealing with unnecessary and avoidable errors in claims caused by impatience, ignorance or just plain laziness. If you don’t know what to do next, ask. If you don’t understand something, ask. It might be a dumb question, but it’s a lot easier to sort out than a dumb mistake.

See I feel welcome already, I've been reading around for a few days now and this website/forum is by far the best ( no it is realy, I'm not sucking up! ) I have just finished the letter requesting my statements when they arrive I'll open a thread in the correct place.

Hello and welcome....

 

First of all spend 3 days or more reading the forum..than decide which bank charges from which bank you want to claim from...Start with only one-easier..Than as Michael advised read FAQ...and than read all the threads about the charges and claims from the paticular bank...again easier to follow..try to concentrate on the large threads..3 or more pages and on the one's that are already won........

Ah well looks like this ones gonna drag still no statements !

 

Letter has been signed for and the £10 was included, had read many posts on the forum from people who requested their statements at the same time as me and they have theirs.

 

Oh well the Halifax have a few more days maybe they'll turn up yet.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

2 days left (day thirty-eight)and a letter turns up saying statements will arrive in 10 days we are now on day 41 my letter is printed ready should I send it anyway? Will it look bad on me if they cross in the post?

Data Protection Act - Non-Compliance letter.

 

Sent 5th April 2007

 

Reading many posts on the forum time and time again stick to your own time line not theirs is drilled home to us all. Non Compliance now sent.

I'd ring them and find out what happening, if you're not happy the file at court, you need the N1, mcol is no good for this

How, if he doesn't know what he's claiming for? Or are you suggesting he guess an amount and add on some for damages?

 

I'd suggest a call to the Data Protection helpline: 01625 545 745.

 

It might be worthwhile contacting your MP, if they are any good: WriteToThem.com - Email or fax your Councillor, MP, MEP, MSP or Welsh, NI, London Assembly Member for free

 

I haven't used this site for a while (after it became clear that my own MP is a complete waste of space), but it allows you to email or fax your MP directly.

This N1 claim now is to get hold of the statements Abo - not for getting charges.

Looks like I'm going to have to do the same for my incomplete Egg statements - not going to make a claim until I have all the details.

The telephone number on the letter says call if the statements dont turn up in 10 days, but that number is now just a recorded looped message saying please wait they will arrive in 40 days. Right so I tried customer servives who after being on hold for ages cut me off twice before I just gave up. Still no statements and at the moment I've no money to file a N1. So for now they are winning. One question comes to mind will I be able to claim from the date I first asked for the statements or from the date they arrive?

you can claim ALL charges, no matter when they were levied, 2001 or 1900, there still unlawful, they'll say you can't because of the limitation act, but don't believe them, have a read up on the act, and threads that are claiming back beyond 6 years, make sure you understand the reasoning, and ask for a copy of your original T&Cs and your agreement:D
