Could i ask for some advice please. I have filed an MCOL claim which FD have acknowledged on 28th FEB stating that they intend to defend the claim by DG solicitors Birmingham. 28 days from then is the 29th March to file a defence. I am out of the country from the 28 March, how will this affect my claim especially if i have to fill out an AQ. Can i contact someone and let them know the situation? Can i delay at all?

It isn't a problem. It only means that they have an extra 14 days to file a defence.

If they haven't filed it when you get back then get judgment.

If they have then you will find an AQ wating for you when you get back.

Many thanks for your help. Rang the court today, they were really helpful and basically said the same as you bankfodder, if they file a defence then i have 19 days to return the AQ,(plenty of time ) if not then tick the judgement box when i get back.
