I am filing on Moneyclaim. It's a joint account and where it says claimant is an individual, do I just put my name as the claimant or should I put both? Its probably a stupid question but I couldn't find answer on here. I have always addessed letter to the bank from both of us and we have both signed the letters. Now we are at this stage does it matter or will it affect the outcome if the claim is just from me?

If its a joint account you have to file it at your local county court and yes put both names

What about a joint account which only requires one signature...... can MCOL be used for that or does it have to be filed at county court as well ?

I have filed mine in just my name although it is a joint accoint and I also included my own account in the total amount with the interest, I am waiting to see their defence but may have made a mistake I will wait and see. The principle is still the same though. I am sure it will be settled before it gets to court.

I just spoke to a lady at Moneyclaim and she although that was a legal question and she wasn't able to give legal advice on the Moneyclaim site you can only put one name.

Think I will try my local court.

What if I put the claim in my name on MCOL and got my husband to write a letter giving me permission to pursue the claim aginst the bank in my name?

The reason I ask is it is going to be next week before I can get to a court and do it manually and I really want to get cracking especially if there are stays being put on claims.

I've not been around for while or would have replied sooner. My wife and I have a joint account with the HSBC, which either of us can sign for. I signed all the letters and put the claim in my name only and it was all successful.

I just finished my moneyclaim form and paid the £120 and pressed send and was feeling great!

Then I decided to have a look at the pdf and I forgot to put my bank account number on the particulars!

How stupid of me! I'm so annoyed at myself I had wanted to get this right!

Have I blown it?

Don't worry about it too much... the bank will have your name and address and can find you from that. Gives em something to do :)

I expect the bank can figure out who I am from the details on the form. I just didn't want to b*gger the whole thing up by making a stupid mistake.

Have you not had any problems then with omitting the account number?

Right so update:

 

DG solicitors sent me anice letter today offering me £2500 as full and final settlement for my claim. My claim was for just under 4k plus the 8%.

Obviously I am going to refuse but my question is can I DEMAND the 8% now that we have passed the moneyclaim stage?

Also if I send a letter refusing this amount how soon will they come back with the full amount? And is it wise to knock back this amount given the stays etc that have gone on on the General thread? I feel the time for offers came and went before I filed on moneyclaim, and my total claim is now over 5k with costs but I don't know whether a court would look dimly on me for rejecting an offer or whether also the court would take dim view of me demanding the 8% be paid now too.

I dont think the court would look dimly on you at all. If you reply stating that your will accept their offer as part payment but will pursue the rest at least your seen as trying to settle this matter. Dont settle for the offered amount, your owed the full amount and dont let the stayed cases put you off, they are been paid! I know its easy for me to say this with your money and its your decision but you've come this far so dont give in to them!! If you really need the money now then you have to think whether or not to settle but if you can hold out for a while then stick with it

 

And yes I think you can claim the 8% now you have filed with money claim, go get em...
