Well I've sent my letter to A & L and now having received my bank statements from Lloyds in 70 seperate envelopes! I am ready to calculate how much I have been charged and send off my initial request for repayment - wish me luck!!

ok finally worked out that Lloyds owe me £695. Took ages to wade through all the statements and put the details into a spread sheet. When I checked this against the list of charges I had downloaded from the internet I notice they had not sent me any statements from 2004 and there were some charges on there! now ready to send letter 1

well I was going to wait untill I get to the filing court documents stage and go for the statutory rate of 8% per day (from the day the charges were removed from my account) I have prepared an excel spreadsheet ready but it really does not add up to much.

For the amount you are claiming I cannot see why you are not going for contractual interest rate which if it is a classic current account is 18.7%. Just fill it in in the notes box. If you have been in an overdraft situation which you obviously have then that is what you have been paying. From the first penalty enter the interest you have been paying every month to the present day,the spreadsheet will take care of the figures.

I will help you through the spreadsheet if you have a problem, use this one

fill in the apr and click the box right of it.

scroll down lhs bottom and click the long green tab

click on charges and interest tab and fill in the charges (unpaid items,referral fees etc). Make sure you put the interest charges in every month since your first penalty, if there is no penalty that month just enter it in the interest column (not the penalty column).

If you are not in the red when the interest is paid find a day in the month when you were then the interest on the penalties will kick in because it won,t if you are in the black. when you have finished click the daily tab and now you will see the diff !

Have now received a standard letter from lloyds saying sorry I am not happy blah, blah and they will look into my complaint within 4 weeks (totally ignoring the 14 days given in letter 1) the very next day received from their duplicate statement department a schedule of bank charges. I have therefore written back to them reminding them that I expect a reply within 14 days and pointing out that they have all the information they require on their computer. Also sent them copies of my original letter, schedule, recorded delivery slip, copy of letter from their statement department and the schedules attached to that letter - all by recorded delivery of course!!

I hear what you are saying but if it does go to court is it not possible that Lloyds could produce that letter as evidence that I was being unreasonable? I know other threads have said that judges do not always take kindly to people rushing straight into litigation so I am hoping that I have covered myself in this way - I'll let you know what happens. thanks for taking the trouble to reply.

You are not being unreasonable and you are not rushing into litigation. You are giving a major financial institution with huge resources an opportunity to resolve your grievance or enter into meaningdul dialogue. 28 days is ample time to deal with your concerns. If the boot was on the other foot what do you think their response would be if you wrote back stating that you might consider dealing with their issues in an undetermined number of weeks? Stick to your timetable.

why have they paid money itno my account?checked my statement today and £805 has appeared (my claim was for £919.41) no letter just a suprise credit. Had received papers from court saying a defence had been filed so what should i do now? I am tempted to just accept the money but on the other hand they still owe me £919 - advice please anyone?
