I sent my DPA letter on the 25th April, a couple of days later it showed that it had not been delivered on the Royal Mail website, so I tried again the next day, and so on.

I phone up Royal Mail, they tell me it will have to be classed as lost, fair enough i thought. When checking my bank statement i find that the cheque had been cashed on the 11th may. I call Halifax, apparantly they have no record of a letter or a cheque, they obviously havent a clue whats goin on.

How the hell can Royal Mail deliver a 1st class recorded item, and class it as lost?

Luckily i get a call from Halifax explaining that they have now found the record of that cheque being paid in. I still havent got my statements/list of charges yet, should they have sent them as soon they cashed the cheque?

The thing with recorded delivery is that it only gets tracked when they have a signature, if they have delivered a batch, they will have got a signature for the top one and only that one will be scanned, it's really not that reliable.

 

I know it costs a bit more but it really is worth paying the extra for Special Delivery.

That's right - and I agree that recorded is often not worth the effort.

 

With regards to the DPA, they have 40 days to supply, they don't have to send things out as soon as they cash the cheque.

 

The 40 days start from the date of receipt, i.e. the day after you sent it, not from the day it is cashed, by the way

Ok thx guys,

 

I always though that they had to sign for each item, now i know. Ill be using special delivery from now on.

They might as well not bother having Recorded delivery, if thats the way it works.

I don't want this thread to go off track here - there are plenty of threads in relation to Royal Snail - but just to finally clarify, the court would not expect you to send anything by recorded or special delivery - the banks certainly don't.

 

It is only intended for personal reassurance as far as we are concerned.

Yep, thats the onyl reason ive been using recorded, just for my reasurance. It just helps me keep track of everything, well thats the plan anyway.

hi all,

I sent my data protection letter on 28th june, on looking on the royalmail website, it doesn't seem that they have received it either.

The only down side on my part is that i sent a postal order, because my bank account is £** overdrawn due to bank charges.

So the only way i will know if they recieved my letter is, if they send me my statements.

Halifax: 12/07/06 Sent prelim letter requesting £4081

Halifax: 15/07/06 Recieved blah blah blah

Halifax: 25/07/06 Sent letter before action

Halifax: 09/08/06 N1 court claim filed at local county court

Halifax: 14/08/06 Received offer of £273

Halifax: 14/08/06 Confirmation from court papers will be served on 12/08/06

Halifax: 15/08/06 sent letter refusing offer.

Halifax: 24/08/06 Settled in full

I sent a letter to Halifax recorded on 9th June..

Royal Mail says still not delivered

But Halifax have sent an acknowledgement of it and a "complaints" leaflet

(still waiting on statements though!

HSBC

09th June 2006 - Data Protection Act Request

21st June 2006 - Acknowledgement from HSBC

30th June 2006 - 33 letters arrive - 6yrs statements

01st July 2006 - Preliminary request for £2868.24.

12th July 2006 - HSBC offered me £1995, I declined.

17th July 2006 - LBA sent, now £2970

01st August 2006 - MCOL for £3778 (inc 8% + fees)

08th August 2006 - HSBC defending ....

31st August 2006 - SETTLED IN FULL - Wooooooohoooooo.

Halifax

09th June 2006- Data Protection Act Request

22nd June 2006 - Acknowledgement from Halifax

08th July 2006 6yrs statements arrive.

10th July 2006 - Preliminary request for £1393.08.

21st July 2006 - Halifax offered £115, I declined..

24th July 2006 - LBA sent, now £1421.

08th August 2006 - MCOL for £1822 (inc 8% and fees)

16th August 2006 - SETTLED IN FULL - woooohoooo

I dont know if they send an acknowledgment to everyone but lots of people have them, I havent. As for Royal Mail, I posted my DPAs to BOS and Lloyds on 19/6/06 and only the BOS one shows up as arrived and I sent postal orders because I no longer have a cheque book so I'm going to the PO tomorrow to see if they know how to check if they have been cashed.

BOS Prelim : 19/06/06 Owed : £382: offered £90.LBA sent 02/07/06, Delivered: 04/07/06. Offer increased to full £382 but with condition. Settled 4/11/06.

Data Protection Act sent to BOS CC : 19/06/06. Acknowledged : 03/07/06 Statements Received : 11/07/06 owed £845

Statements received for closed BOS account: 27/07/06, Owed £2596.52

First claim on closed BOS account now started - £735 Prelim received 7/11/06 LBA sent 5/12/06, Offered Full £735 but with conditions. Claim filed 22/01/07

CapitalOne-£1247, settled in full.

LloydsTSB- £910, sttled in full.

Yeah i had a letter of acknowledgment after my LBA, i had to send that special delivery. My first two letters were not signed for even though they were delivered recorded..was a bit of mission trying to get halifax to even acknowledge they had got them.

You can check if your postal order has been cashed - so long as you have the counterfoil..... theres a form to fill in at the Post Office or I think you can call them - numbers on their website.

 

Went to the PO yesterday and asked for the procedure on checking if a postal order was cashed or not and was told that a p.o. can be cashed up to 6 months after sending it and I would have to wait until then, not very helpful at all. To say I was p***ed off is an understatement.:mad:

no thats bull - telephone the post office customer service at www.postoffice.co.uk - they'll send you a little form to fill in and send back with your counterfoil and they will tell you when and where your PO was cashed.
