    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. They also say they do not/will not disable any smart functionality when they fit a smart meter I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sent off my first reclaim letter on 7 March to my local branch. Received a reply today from my branch thanking me for my letter which they claim to have received on 14th - a full week later. Do i now have to wait 14 days from 14th before sending off the second letter or can i send it 14 days from the 7th? I was intending to allow a couple of days lee way but not a full week.

 

My kind caring bank manager is sorry i have found cause to complain but welcomes the opportunity to address the issues i have raised. Their customer relations unit will be in touch shortly and they are committed to handling the matter quickly and effectively as i will seef rom their enclosed leaflet - which they didn't bother enclosing :-|

Ok i'm going to stck to my own timetable and will post my LBA tomorrow unless anyone can advise otherwise.

 

Just out of interest what i am claiming back are direct debit create and cancel charges, irregular account charges, unarranged borrowing fees and referral charges. A total of almost £800 over the last 6 years. I take it i'm entitles to claim all these?

dont think you are able to claim dd set up/cancel fees as these are charges for a service not a penalty ! the others are fine !

no you can alter your amounts in any letter but when you issue court proceeding you have to make sure you have your totaals right every things fine up to then !

No Hephalump I sent for the statements at the end of January and received them after about 5 weeks. There was no acknowledgement letter or anything. They wrote to me telling me my statements were ready for collection at my local branch

Sent my LBA off last friday 23rd and today received a letter dated 22nd from the bank's customer relations unit. Apparently the charges are fair, reasonable and transparent and they will not therefore be making any refund.

 

Can i now move to start court proceedings, or, as my LBA was sent after they issued this letter, do i still have to give them the 14 days to consider that?

give them 14 days ! should your case go to court by giving them 14 days it shows to a judge you have been reasonable in trying to negotiate a settlement ! stick to your schedule if nothing heard in 14 days issue proceeding although i think you will find they will credit your account with a goodwill gesture anything from £60 to £150 has been known to be credited to other claimants accounts if that happens just subtract it from your total and claim the remainder through the courts ! they will settle before it goes to court as court is the last place these peoplewant to end up in just keep the chin up and keep at it you will get there in the end !

hiya curleybap, we would follow the english version, it's 8% statutory interest here too. i also read somewhere that in norn iron we don't need to bother with a preliminary letter, you can just wade in with a letter before action, and also - reassuringly - that ulster bank don't drag things out, unlike some. all the best!

Curleybap, I have lodged an on-line claim against the Ulster Bank. The small claims court in Belfast was extremely helpful. Their details are on the Northern Ireland Courts web site..

I used the English spreadsheet and claimed 8% interest. You have to limit the amount claimed to £2000 and state that you are willing to abandon the excess. You claim the interest on top of that so if it excee£2000 it is ok.

I'm waiting for a response now. Will keep yyou posted....

Thanks Hamishcat and good luck. Yes please do keep me and everyone informed. I had a quick look at the Small Claims website before and it looks pretty straight forward (hopefully). Can i check - what is the date the claim arose? Is it the date of my first letter to the bank requesting statements or the date of the first charge? And what date do i claim interest to?

the earliest date you can claim from is 6 years back from the date you lodge the claim, or the date of the first charge, if that is later. the spreadsheet i used calculated interest on a daily basis right up to the date i filled it in (and updated it every time i opened it) - you just log the details of what you paid and when, and it works it out for you. all the best!

Hi Curleybap

I am doing my brothers claim for him. I live in Wales but am claiming from the Ulster Bank from when he lived there. The problem is the claim is for over £3000. Does Ulster Bank have an English address so i can use mcol from here.

Sorry for the late reply Nuala. I haven't been able to find an address for Ulster Bank in England. I have been writing to my local branch here though the last letter i received from them was from their Customer relations unit at Group Head Office, 11-16 Donegall Square East, Belfast, BT1 5UB. Their number is 028 9027 6025. Good luck.

Know what you mean....Since filing on line there has been an onimous silence. Also, just realised how much photocopying I'll need to do. I am waiting for the court to ask for my 'evidence' before I start.I hope this is right but their website is pretty good. Good luck curleybap!:roll:

Help our account is joint but we have set up an either or agreement, in that one or other of us can request information with regards the account.I had originally sent off letter with my own signature. The bank now 36 days on have returned that letter stating that we both must sign and the 40 days will only commence from the date they receive that letter....please help because Iam at my wits end.

Hephalump i'm not sure where you stand. If i was you i'd contact the Information Commissioner and get their advice. There are some details attached to the DPA request letter in the templates library. This could then be followed up by a quick phone call to the bank. Good luck.

 

You should start your own thread so that more experienced members than me can see your posts and give you better advice.

I'm new to this forum but after recent experience with Ulster Bank ..with whom I have been a customer since 1966!! ... I am about to try to claim back my "unfair charges". They do not amount to very much...I am a very careful spender :cool: However I am so annoyed:evil: at the attitude of the "Customer Care???? Assistants at the Ulster Bank Mastercard Call Centre that I will claim what I can.

 

What do you think of this scenario ...

 

Statement 17/01/2007 ..minimum payment (£151) due by 11/02/07 No Arrears .. payment (£600) reached account on 9th February.

 

Statement 17/02/2007 ..minimum payment (£175) due by 14/03/07 .. payment (£300) .. although made on-line 12/03/07 did not reach MasterCard account until 21/03/07 so 16/03/07 "late payment charge £12" raised.

 

Statement 17/03/2007 ..Arrears £175 because of late processing of March payment. Minimum payment (£354) due by 11/04/2007 - note here that I had already paid £300 on 21st March ..on line payment (£300) made 10/04/07 ..I know..a little late:-? and so not processed until 12/04 (1 day late!) so another "late payment charge £12).

 

 

Result over three months ... Total of Minimum payments due... £505.

 

Total actually paid ...................£1200.

 

Account up to date at 12th April.

 

Late payment charges.................£24.00

 

So although I paid more than twice the amount I needed to ..because I was a little lax in choosing when and how much to pay at any given time ..presumably when I thought I was paying early I was actually "paying late" ..I received a penalty of an additional £24 added to my account. Yes I should have looked at the statement to see exactly when I was "allowed" to pay ..but surely the fact that I pay regularly once a month and always considerably more than the minimum amount should

count in my favour...apparently not to the "caring Ulster Bank".

 

Yes I know..as the Call Centre "ladies" chanted over and over again like automatons "you broke the terms of the agreement":D apart from that they refused to discuss my account except to say that I would get no refund of the charges. I went from the initial female to her manager ..but they could both only repeat the same thing and blame the

computer for not allowing them to look at my account as an individual

case. As a "Senior Citizen" I tried to explain that £24 was quite a large sum to me ..they didn't care ...in fact if David Walliams (Little Britain) ever

needs a stand-in then either could fill it nicely "The Computer says Noooo!"

 

I would add that my Current Account is also Ulster Bank "uFirst" and that I make my online payments through the Ulster Bank Anytime on-line website

by transfer from one account to the other with a few taps on the PC keyboard. Why this takes four or five days to transfer to Ulster Bank

Credit Card accounts Heaven knows...the Call Centre certainly doesn't!

In theory...to an OAP like me ..my money is in the Ulster Bank...I pay it

to the Ulster Bank before the due date so they already have the money in their "system" somewhere ...how it gets from A to B should not really be

my problem and I certainly shouldn't have to pay £24 extra if they can't find it on time. I suppose to stop this I will have to arrange a direct debit

..I don't really want to as I prefer to pay in varying amounts as and when I can. Of course the Credit Card Companies prefer minimum payments so they can keep on adding the interest. They certainly don't want you to pay early .. but only when they give permission .. and with knowledge that they can delay processing the payments for a few days or even hours and catch you with the "late payment charge".
