This new nudge would be a brilliant idea, I have been meaning to nudge for a few weeks but since oft announcement, got no idea how to word it, of course we all know that DG will apply for a stay so need to make that clear need to convince them that they'll have even more to deal with after the test case if they don't clear some of the backlog now. while I'm here I've asked this a couple of times but no feedback, can i complain about hsbc not replying to one of my claims within the 8 weeks if that 8 weeks was well and truly up before the announcement?

Ok I have asked lat her thoughts on a new approach with a nudge and she has put it into order using the above ideas. I have sent it to pete to get his thoughts on it before posting it on the forum but hopefully should have it ironed out and ready to use very soon!

Well after much deliberation and off line chat there is a new nudge available if anyone wants to try it. I don't want to post it on the open forum as the feedback I have had is not really that positive. The idea is good and the content is basic common sense to us mere mortals but the fact is that dg will do anything they can to avoid making any payments before the outcome of the test case even for reduced amounts!

I would only recomend offering to settle for less if you feel you have no other option, but after taking on board the opinions of others I wouldn't hold out much hope of an offer. There is nothing to lose but I really don't think it will have any effect on the way they are handleing things. The banks are hoping that as a result of the test case the amount they will have to pay out will be much less than the claim total at this point.

I will send it via pm to anyone who would like to use it!

Did you ever do the nudge that was discussed earleir on your thread? IMHO you probably won't even get a reply from DG. I never did and that was before the test case came about.

Hi once again...

 

i never sent that nudge.

 

Sorry havent been on for a while but i had kinda given up hope on this one until i seen the thing in the paper last week saying banks were gonna lose the case :-)

 

Had a letter from the court this morning saying that my case will be stayed until march 2009!!!

 

do you guys and girls have any further developements or anythin i can do to maybe get back on track?

Hiya Richard, never loose faith :D.

 

we know for definite that the stays will be in place until 23rd May when there is a case management meeting and we should get a clearer view of how the banks and the OFT will react to and proceed from the first judgment.

 

anything past that date is really just supposition so watch this space at the end of May :).

The first phase of the test case is over and the first instance judgment was handed down on the 24th April. The banks and the OFT now have a month to read and mull over what this says and then decide on their next moves.

cant find the links your on abaout, only one saying if u have let the bank put your case on hold you have made a mistake?

 

Would a letter to DG be of any use now they have lost in the OFT test case?

I doubt a nudge letter to DG would do any good at all. They have never done any good in the past.
