okay been having a good read. and so a few little questions.

 

in the prelim approach it states in red that

 

'Additionally you have entered a default notice against my credit record blah blah bllah etc'

 

how do you know if this is the case?

does this only apply to credit cards?

 

 

also, is it worth claiming the overdraft intrest? as i am completely lost when it comes to the spreadsheets by vampiress.

 

also i dont really see much difference in the prelim approach, and LBA?

First question a default is a negative entry on one or all of your credit files held by credit reference agencies.

This relates to any default you have made after entering agreements under the consumer credit act and is usually reported to them by debt collection agencies following their buying of your old account from the bank.A default could mean anything from non payment of a telephone bill to non payment of credit card arrears.If you dont know how your credit file is looking then you can get a copy from either of the 3 agencies

Online Credit Reports and Credit Reporting from a Leading Credit Agency: Equifax

Obtain your credit report & score to work out your credit rating - MyCallcredit.com

have a look at their sites a copy of your credit file costs 2.00 and worth looking at.Info is not nec the same on each file so its worth getting all 3 !!

 

As regards the prelim and the lba there are differences but I will leave you to study them.

I will say that before court you need to show that you have encouraged or tried to ...dialogue with your bank and given them a chance to address your complaints and one 14 day letter alone would not really be convincing that you had.!!!

You will see that from start to finish there is a pattern and escalation of formality.

You should stick to this at all times.......its what the banks have come to expect and shows your willingness and integrity to address the issues professionally.

 

On the question of interest........by the time you get to this stage you will already have put lots of effort in......this is an area that lots ask questions and seek advice for.......if you try and read a little more and look at some examples between now and doing your claim for court then most of your fears will have gone away.

There is always assistance here with this..usually by people who just like you now were fearful of it before the time.

 

now ball back to you...........feel free to ask any questions but only if you cant find the answers........its amazing how many other good informative things you will find when looking for another !!!

Of course..from what you say...........it obviously doesnt apply to you.

 

Just remember though there are 3 main credit reference agencies and it doesnt mean if you dont have defaults on one that you wont have none at all.

Experian and equifax are the main ones of the 3.

 

You can of course address the default question later on even before court if you do find there is one listed against you.
