Hi

 

i have been looking at your site for the past few days, and it has been really helpful. My charges over the last five years add up to about £750. Do i add the 8 % interest or the 24.9% interest and should i put that in my 1st letter with my breakdown of charges.

Dont want to get it wrong and to be honest i am terrified at the prospect of it going to court but at the time i incurred the charges i had some really crap problems, Nationwide were charging me wevery month sometimes £150+ and offered no help at all in terms of managing my account.

Also i have three acounts that the charges apply to should i put the claims on all on one spreadsheet and expalin in the letter that they releate to three seperate accounts and give the account numbers?

Claim the 24.9% C.I. at the Preliminary Letter stage enclosing your spreadsheet breakdown. Update the total Claimed when U send your LBA and also when U File @ Court.

Claim the 8% s69 S.I. as 'In the Alternative' @ the Court stage and not before.

Dont want to get it wrong How's that going to happen when U only have to ask others on CAG if U are still unsure of things?!...to be honest i am terrified at the prospect of it going to court. It WILL involve U having to File your Claim @ Court though!...But it is Nationwide that is the Defendant...NOT U!!!

...Also i have three acounts that the charges apply to should i put the claims on all on one spreadsheet and expalin in the letter that they releate to three seperate accounts and give the account numbers?Your choice really...I personally would group everything into ONE Claim, so as to pre-empt Nationwide trying to bamboozle U when they start to pay U piecemeal during the Court process.

Hi

 

I have sent off my two letters got the first one back with the open and transparent stuff! Sent off the second one and have heard nothing. It is now 14 days. I know that the next step in MCOL but i am a bit confused. In my initial two letters i have claimed for contractual interste. Can i still claim this now as eerything seems to say you can only claim the 8 % now. Please help i am very confused

There has been recent evidence of Courts viewing contractual interest claims as punitive.

Therefore it is essential to be very sure and have some understanding before claiming it.

As Michael says you should list s69 in the alternative.

Send a copy to the court, clearly marked with your claim number and details of the parties. Send another copy to the bank, again clearly marked with the claim number and with a covering letter so they can link it with your claim, although I'd hold off sending this one until after the date that the claim is deemed served (the court will tell you when this is).
