      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I've sent my prelim letter to abbey and recieved my 'we need to investigate - wait 4 weeks' letter. I will wait for the 14 days to be up before sending my lba.

 

My claim is just over £600.

 

I hope to keep you informed of my progress and any advise from anyone else v abbey in Scotland would be much appreciated.

Well I sent my Letter Before Action (LBA), and 2 weeks later I have received their reply (below). I'm a bit nervous now.

 

I have now printed off form 1 & 1b Scotia kindly stuck in the forum http://www.consumeractiongroup.co.uk/forum/scotland/6165-scottish-procedure.html and I'll visit the local sheriff court clerk tomorrow and get some more advice on how and what to fill in (just to make sure I don't make any mistakes).

 

Reply to my LBA

 

Thank you for your letter about the charges on your bank account.

I have now carried out a full investigation on your behalf.

 

I'm sorry you are unhappy with the charges and I understand you would like these refunded.

 

I can confirm the charges were applied correctly, as you had insufficient available funds at the time.

 

As we have previously refunded charges as a gesture of goodwill, I am unable to agree to refund any further.

 

I appreciate your feelings on this matter but we are satisfied that the charges do not contravene the Unfair Terms in Consumer Contracts Regulations 1999.

 

We also comply with the Office of Fair Trading, in dealing fairly and openly with our customers.

 

When opening your account you were provided With information detailing the terms and conditions.

 

We have also sent you regular updates and Tariff of Charges, which detail the amounts of our charges.

 

I have enclosed a further copy for you.

 

To avoid charges in the future, please ensure there is enough money in your account to cover direct debits and other payments made.

 

I would also recommend checking your balance regularly, through an Abbey cash machine, online and through calling our Telephone Banking Centre on 08459 724 724.

 

Please be assured I have carried out a full investigation for you and I hope you feel I have offered a considered and complete response to all of the issues you've raised.

 

I will keep your file open for the next 8 weeks and if I don't hear from you within that time, I will assume that everything is resolved and will close your file.

Today (Wed 4th/4/07) I visited my local Sheriff's Court with my Form 1 and 1b. The clerk was very nice, gave my forms a once over and I handed over a cheque for £39. Took about 3 minutes. Apparrently they're quite busy and she told me it could be as late as the end of May before the hearing.

 

I'll post more when I hear more.

Today, 19th April '07, my friend checked her account only to find that abbey have paid her the sum claimed for plus the court cost of £39 (made available 26th April '07).

 

Victory! :-D

 

I'm now going to tackle her natwest account too. I'll open a new thread next week.

Just like to say well done. I am about to fill in the forms to take capital one to court. What was it like, what court?

 

Did they give you a offer at first as C1 have paid a small amount to my acc but i want to claim the whole thing and am stuck filling in the amounts

Thanks lori, j1mgg - I've altered my signature (in red) below to show the steps I took. No, they didn't make any offer. I just got the standard replies from them, filed my forms at Falkirk Sheriff's court and 2 weeks later a cheque from abbey head office was paid in to the account, a whole month before the return date!

 

I'm not sure about your amounts problem. I'm sure if you posted in detail the bit you're stuck on in your thread, someone will have been there already and can advise.
