      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just started second claim against LLoyds they have taken £385 plus 42 interest this morning as expected -I had previously written and received letter from Andover requesting them not to take the charges-obviously ignores Prelim letter sent today

 

Still waiting on response from Lloyds on mcol regaring 1st claim they have until 17th april

Guidance Please

 

My first mcol 14 day deadline passes next tuesday 17th ,what is the best route if lloyds have nt filed a defence by then there is an option to go for an automatic judgement ,however on researching the site this doesnt seem to be used

I would fully expect that Lloyds will file a defence and will also file an aknowledgement of service which will give them a further 14 days to do so. However it will invariably be at the last minute. Just a little game they like to play.

Hi Ironman,

 

Lloyds have a habit of filing a defence at the last possible moment, or sometimes a day or so after the last possible moment.:mad:

If you haven't heard anything by 17th i would give the court a ring to see if they have filed a defence, and whether you should apply for judgement.

Hi Ironman

 

Just to add that it'll be better for you in the long run if LTSB do file a defence as they will then have played another card which will box them further into a corner. For as long as a defence is not filed they can later claim not to have received something and apply to set any default judgment aside.

Just been online with mcol had ny claim acknowledged by Lloyds on 12/4/07.

 

Spoke with mcol Lloyds now have a further 14 days to file defence which runs out 1/5/07.The helpdesk told me if they miss that deadline I can enforce judgement .

 

I ll wait and see what shenanigans occur from Lloyds

You are unable to take any further action online on this claim.

 

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

 

So I suppose I just sit and wait for court to write to me?

Got my court transfer papers this morning

 

no requirement for allocation questionaire

defence from LLoyds 7 points looks similar to others in this forum but ill post it up any way next day or so

 

I suppose i just wait for court date next ?

A quick word of support Ironman! I'm just a few days behind you and wish you the best of luck. I also wanna thank you for inadvertently answering one or two questions I had in your thread! I received my Acknowledgement of Service this morning, filed on the 2nd - just 1 day short of their deadline! I gotta sit back and wait for defence to be filed now.... Roll on the 17th May! P.S. I'm claiming 6 years and £2032.50 so far...

hi guys

 

Claim 1 - got a court date 25/6/2007 no AQ required as apparantly loads of cases on that day being heard with same defence .Lady at court says probably won t get that far let them know when settled .Still gotta pay £100 court fee

 

Claim 2 MCOL filed today £595

 

Also had a letter from LLoyds tsb Collections this morning requesteing payment of £2144 else they are going to register default any comments re my response to them?

what's the collection against? your account? loan? if it's a loan and you are up to date with payments then they can't have you, if it's your overdraft then technically they can claim it back if you fail to comply with t and c's but your account is in dispute, assuming it is against the account you are claiminbg for and they cannot do that. there are posts about that on here. I'll have a look....

Don t know if anyone else has had this experience I ve had conflicting advice from my court regarding the £100 fee required for Allocation Questionaires.One employee has told me still needs to be paid another not so as the AQ has been dispensed with.

 

Anyhow I ve been told to write to the court manager stating the above and he will advise accordingly

U would nt believe this since my post regarding what to include for court Post has arrived to letters from SCM

 

First one saying blah blah contact local branch for review]

 

second one with full and final settlement offer of my first claim £3802.71!!!!!:p

 

Happy Days got to read their letter agree to terms and send back

 

 

Any advice on whether to continue process of claim etc

Congratulations, You don't have to agree to their terms by the way. Just write back crossing all the terms out of their letter you don't like and go book your holiday:DWrite to the court telling them it's settled once you have cleared funds in your account.
