You'll all no doubt be aware that banks have now begun sharing our bank account details to the CRAs. I have just discovered how 1 of them at least, Alliance and Leicester, are using this totally inappropriately, inaccurately & in breach of the DPA.

 

My credit file today shows a '2 month late' marker against my current account - fact, I was NOT overdrawn in January at all, fact, I was overdrawn for 3 or 4 short periods in February and am now back in credit.

 

What the hell right do A&L think they have to record a 2 month late marker for that???? Yes, where it's a credit account and you miss the monthly payments totally, but according to the above, they seem to think they can place a complete monthly late payment marker every time you go overdrawn - even if it's once, even if you're back in credit the very next day!! It's outrageous!

 

N1 for my bank charges from A&L now being duly amended to remove their breach!

Settled Claims:

Abbey: £4025 Claimed 27/02/06 - Paid in full 19/06/06

NatWest: £4529 Claimed 10/05/06 - Paid in full 1/08/06

Halifax: £1150 lba 18/05/06 - Paid in full 07/06/06

Natwest CC: £420 Initial letter 25/07/06 - Paid in full 08/06

Woolwich: £1100 Paid in full 28/2/07 + Default removed

NatWest Pt 2: £1700 Claimed 10/05/06 - Paid in full 7/2/07 + Defaults removed

 

Current Claims:

Abbey Pt 2: £2300 + adverse credit removal claimed 23/03/07

Alliance & Leicester: £1421 + adverse credit removal claimed 23/03/07

 

Refunds pending:

Capital Bank: Swift Advances: Halifax

 

Son's Refunds pending:

Abbey: HSBC

I have the same issue, its strange indeed.

 

I have a joint account with the wife, First direct current account.

 

On her credit file it shows all 0's (weve not been over our limit in years)

 

On mine it shows 0002100000

 

So basically it looks like ive been over my agreed limit for 2 months in a row, when we havent, and why the discrepencies in mine & the wifes file for the same account?

It's one thing to process a late month marker when you ARE a complete month in arrears or not made a due monthly payment on time each month, but here they're trying to impose a new rule now - that they wrongly seem to think gives them a right to give you a month late marker simply for going overdrawn once - even if you were to repay it the next day!

 

I can see a LOT of people being up in arms when they find this out - how many people go unauthorised overdrawn for a short period?!

They've just done the same to me for the last 2 months. Since I won judgement by default in February,they have been responsible for taking me overlimit with their charges and to top it, have now issued a default notice.

I am not 100% sure but even though it's a joint account I bet you are the "hidden" main account holder. It looks like your other half will have 0's no matter what happens, but you will get the stick for anything negative.

 

Speak to the data controller straight away about this..
