      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

DPA response arrived yesterday, total of £490.00, all in 'Returned Item Charges' since 2001.

 

Prelim Letter going off today. This account is held in Edinburgh (206 St. John's Road, Corstorphine), not Dumfries like my other account, in case anyone's interested.!

Thank you for your letter dated 19th May 2006, I am sorry to learn that you are unhappy with the charges you have incurred on your account.

 

I am sure you will appreciate that like other organisations we incur costs for every transaction made. When we pay an item against an unauthorised overdraft or return an item unpaid, we incur extra costs regardless of the shortfall invloved. We believe it is fair to pass these costs on to the accounts affected, rather than absorb them into other areas of our operations, penalising all our other customers as a result.

 

We clearly outline our charging policy in the terms and conditions that apply to your account. In addition, we are committed to complying with the Banking Code, which sets standards of good banking practice for banks and building societies to follow with dealing with personal customers. The terms and conditions of your account state that you must have funds in your account to cover your transactions. We cannot be help responsible if you have authorised payments against funds that were not available.

 

We are keen to help you avoid any unnecessary charges by providing various ways to keep track of your account. Called them up, as per usual the person I spoke to had never heard of the person that sent me the letter.

 

Told them I'd accept their £100.00 goodwill gesture, but would still be looking to recover the remaining £390.00 within my original timescale.

 

The girl on the phone said she'd escalate my response, but they could take anything up to 8 weeks to reply (aye right!) as they're "inundated with these sort of calls at the moment..." aww bless!

 

LBA printed & sat in envelope, ready for Friday's post if there's no sign of my refund!

Just had a phone call from Alan Park, Customer Relations at HBOS.

 

He's sending me a letter this afternoon, with an offer of a FULL REFUND of the £490.00 charges on this account.!!

 

FAN-BLOODY-TASTIC!!!

 

He also said that, altough he couldn't guarrentee it, he expects the same thing to happen with my Current Account (against which an initial claim of £700 of a total £895 has already been submitted) shortly.

 

Stick to your guns people - they WILL pay out.

Sort of, this was the 2nd Account with them that I'd started action with. I'd already submitted the court papers for the 1st one after they ignored my LBA.

 

What was the time scale from the first contact to this offer ?

 

If you include the DPA Request, then it'll be quite a while, DPA request was originally sent in on the 8th March, not actually received the refund yet either so I'm still not quite celebrating yet until I see the numbers appear in my account.

I take it this offer is for the account that you havent filed the action for yet?

 

Are you going to let them off with the 8% interest then as I wasnt sure what to do if they phoned to make an offer now I've raised the action. Im sure I read a post somewhere that someone told them (when they phoned to offer a full refund) that the offer had to include the interest or they would continue to court and the bank caved in, but cant find it again now.

 

Anyway keep us posted

I'm note sure yet - this account is only at the LBA stage, so I've not raised any court action yet. My other account IS with the courts, with an initial claim of £700 (from a total £895) so I will be looking for the lot from that one, i.e. FULL refund, plus 8% interest, plus £39 court fee for me to not take that one through court.

 

One thing that occured to me last night, no doubt their offer of £490.00 will come with a FULL & FINAL settlement form for ALL accounts, like the previous two were.

 

Could this be a final, VERY sneaky, attempt to gain some ammunition for not paying out the case that's with the court?

 

Can anyone advise please? My gut reaction is that something's a little fishy here!

Hi JMio,

 

If there is anything on their offer letter that you don't agree with (ie. FULL & FINAL settlement form for ALL accounts) just cross it out before you sign. Make sure you keep a copy so you have proof of the amendments and when you send it back attach a cover letter explaining why you have done so.

Signed it, added a line explaining that in no way does this affect my stance on any other accounts held with BOS, and that my case relating to my Current Account held at Dumfries branch is in no way affected by this acceptance form.

Data Protection Act sent to BOS CC : 19/06/06. Acknowledged : 03/07/06 Statements Received : 11/07/06 owed £845

Statements received for closed BOS account: 27/07/06, Owed £2596.52

First claim on closed BOS account now started - £735 Prelim received 7/11/06 LBA sent 5/12/06, Offered Full £735 but with conditions. Claim filed 22/01/07

CapitalOne-£1247, settled in full.

LloydsTSB- £910, sttled in full.

wrote asking for details of last six years bank charges recieved copies of all statements no letter total to about 3250 whats the next step grateful for your advice

 

June, welcome aboard!

 

First thing to do is have a good read through the FAQ section, pretty much everything you need to know is in there, after that start your own thread under the relevant organisation (e.g. June45 Vs NAME OF BANK), and post any questions in there, people will help you out this way!
