      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I am claiming back my back charges from Lloyds TSB and have sent off all letters up to the LBA letter. I have never received a reply from Lloyds. I was wondering if I should try ringing them warning them before I proceed with the court action?

 

If so, does any one have a number that is best to contact them on?

Just a quick update, I have proceeded with money claim, still no reply from Lloyds (like i'm bothered:-D ), so hopefully will of finished lodging the money claim by end of today and will keep updated on my progress.

Another update- My claim has been transferred to my local court (Harrogate), and they have decided I dont need to do the AQ. The last communication I have had is the Notice of Transfer of Proceedings dated the 8th May. Should I just be waiting for a court date now then? LLoyds TSB's defence is the same as many I have read on here, nothing different in it as far as I can tell. Any advice as to what I should be doing next?

Thanks for the reply Barty, was very useful thank you. The case had now been transferred again, this time to Leeds County Court. I am a bit worried by this, and keep thinking I might now be taking on more than I can handle, I dont know why it has been transferred again, it says in the letter that it was the courts own motion, and was made under the courts own initiaitive without a hearing. Is this anything to worry about?

Hi Jess , you are very near me and at almost the exact same stage so hopefully we can cheer each other on , and if your court date is a date i can get of work will give you some moral support if you need it , i'm waiting to hear if mine is at York or Leeds , also with lloyds transferred to York last week , but they say probably be sent to Leeds as they are backdated to November , but nearly all that get transferred to Leeds end up at Mercantile so worth reading the thread mentioned above , good luck ,lisa

hi lisa and jess our court case against tsb as been transfered from 4 different courts and is now at mercantile court on the 28th june ,

have u had any updates on oue dates,

we are at the stage of the cpr 59 letter for the court , so anything upto this stage may be able to help you out alittle

They told me to ring back today , so i did , still not come back from judge , but good news is he also has the order for draft directions aswell and is looking at them she said should have been back today so hopefully should hear something next week now , keeping fingers crossed for draft directions to be ordered , keep fingers crossed and touch wood !!!

I'm Now Getting Really Worried Have You Heard News About Hull Courts Just Striking Out Cases Cause Of That One Lost At Birmingham , I Really Hope I've Not Lost £220.oo Court Fees Plus About £50-75 In Postage Etc Really Can't Afford That Have You Heard Anything ?

Had a letter today, yep, as expected been transferred to Leeds Mercantile Court.

 

 

hi hun great news that , at present theres 240 cases but 30 have been settled

i have put on a thread for anyone local to me to email me so we can check through everything and just to make sure really for piece of mind with quite a few claims been thrown out , im just hoping that we have done everything correct and not missed anything, seem like you dont need a court bundle for the 28th but ive read could be better if you are prepared and have one , if you not far and can get intouch [email protected] thanks hun

Hiya, had even better news today!! Got a letter from lloyds solicitors saying they are settling the claim in full, should receive my cheque in next 28 days!!! Thanks to all those who helped along the way, your advise is invaluable, and I truely appreciate all the help the site has offered xxx

Congratulations on your win - however this is a ridiculous amount of time for you have to wait to receive settlement. Do not agree to stop proceedings against them until payment in full has been received. There is absolutley no reason why they should keep you waiting this long.
