    • Hi.  mom not internet savvy but basically upon opening the thread if you googled her Elizabeth turner breeder (yes breeder sorry),  her name and genetic puppy farming flag up.   it shows CAG put it up.  Iv told them that.   iv also told them it’s not slanderous as you have seen the vet reports proving it.  I really don’t care if it remains.  I made it clear it was out if my control.  if it cannot be done, I will copy them into the old cachet message.   thank you. 
    • Hi. Could you tell us who the email is from please? And when you say 'her name', do you mean the breeder? Have they told you where on Google the name is visible? It's possible that an older part of your thread is in a Google cache somewhere and I don't think anyone can remove that. HB

    • Do you have historical meter readings from before the meters were changed? And more recent history showing consumption, in metered units not in £s,  since the change. One specific thing to check is gas. Check that the meter and the bill use the same units. If the meter is recording cu.m but they're billing as if it was counting 100 cu.ft, then your bill will be nearly three times too high.  Overall I'm guessing it's an Ovo screw up. It's significant that they didn't block the transfer, maybe they aren't so sure of their position.
    • Hmmm, interesting point. In my career, that I am retired from now, there were an immense amount of rules and regulations that one had to adhere to by law. The qualification process is rigorous with on going assessments throughout your career and re-certification every 12 months. If you were shown to be not competent in those rules and regulations you could not hold the position and the operational consequences of that could potentially be dire. In the same respect, perhaps a judge who is not conversant in the rules of POFA should not sit in on cases that requires proficiency in that area? I also bow to your considerable knowledge in this area, perhaps I shouldn't be commenting but by doing so I find it helps the learning process. Your last point has just reminded me of something that may help my case, thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have sent the letter to abbey requesting the charges be paid back, the 14 days are nearly up now and was wondering if someone could advise as to my next stage. Do i file at the court before sending the next letter (which states the courts name in it) or do i send the letter and wait for a response before filing at court?

 

Meant to say, I am from Scotland and will be filling in an English court, i am hoping to file at Carlise court can i do this on line at the moneyclaim online?

pretty sure you need an english address for mcol, also, was the first letter you sent the prelim? if so you need to give them another 14 days (letter before action) to satisfy fsa guidlines for time to investigate a complaint before taking court action. good luck!

The first letter i wrote was this;

 

I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Abbey National of going into unauthorised overdraft.

 

The charges total £1959.00, plus as I believe I have been unlawfully deprived of the money I have calculated £222.39interest at the statutory rate, the amount the court will award.

 

I therefore ask that you repay me the full amount of £2181.39. I have attached a full schedule of the charges and interest with this document.

I look forward for a full response to this letter within 14 days.

I know about the English address (but thanks for the info) i have got information about getting one of another thread on this site.

Any more help would be great though :p

Does the 14 days run from the date on your letter or the date they recieve it? I sent my letter recorded it was dated the 2nd March but they did not recive it till 8th March, don't want to be pushy nor make a mistake.

If you have given them 28 days in total, that is deemed to be a sufficient amount of time for them to investigate your complaint. All my timetables go on the assumption that the letter was recieved the next day.

14 days were up on saturday so sent my LBA recorded delivery, although i did recieve a reply stating they were looking into my complaint and would wright to me within 14 days. Sticking to my time scale though so the clock is ticking (10 days to go):lol:

I would ring them and firmly but politely ask them to reverse their latest charges. They will try and tell you they can't, they may say they have reversed charges for you before and therefore can't reverse any more, or they may just say they won't. However if you are firm, ask to speak to a supervisor, explain to them the fact that you are about to bring court action for previous charges and it would be in their best interest to cancel the charges. It has worked for me the past 2 months!!

After some advice please.

Just recieved a letter from Abbey this morning saying;

 

'We've noticed that the way you run your account has changed recently and wondered if we can help?

We're happy to discuss any concerns you have, or run through your options if you've had a change in circumstances. Just give us a call on the above phone number or visit your local branch.

 

If things stay the same, we may have to withdraw your overdraft. Of course, if this is necessary, we'll let you know in advance.'

 

 

The letter is from Cathy Robertson, Head of customer service banking.

 

Has anyone else had anything like this?? I am a week away from filling at court. Not sure what this means.

Beckz, it means absolutely Jack, ring them if you want and explain what you are doing and see what they say - it has to be worth it for the amusement factor but that is all it will be good for :D

I have sent the prelim and the LBA, also have my English address just need help filling in the MCOL form

 

 

Try this its in the bank template libary: 5. Money Claim On-Line (MCOL) Particulars of Claim this is what you need to put on your MCOL, it does not give the full particualrs of claim so after you have submitted the MCOL you then need to send the courts the full particulars of claim. You will find it in the bank templeplate libary, I think it comes under the N1 full particulars of claim just amended it to your details print it and send it to the court anda copy to the shabby's solicitors

Cheers very much, just read it although it didn't make much sense to me. I read on here that you could claim back the cost to me for doing this, i have been posting all my letters via next day recorded delivery at £4.10 a time can i get this back?

Need some help please, Due to file my MCOL on Saturday, but not sure what to do after that, i know i have to send the list of charges to the judge but not sure were to send to or what else needs sent with it. Also how do i claim back the expenses to myself e.g. the cost of posting the letters etc. :)
