At the moment we are advising that you hang tight on the ERC claims. This will change and information will be posted when it does.

 

Firstly send an SAR to the mortgage company to get a full list of all the charges ect

 

Then send the prelim letter for the charges.

 

Please Please Please, read your contract carefully some mortgage providers have clauses that allow them to charge you their legal fee's. Also make sure you have read the FAQ's and the know the court procedures inside out incase it comes to that. Forewarned is forearmed;)

I have now received my statement.

 

I have been charged a total of £50 for unpaid Direct Debit.

 

I redeemed by mortgage within 2 years of completion. The contract states that they will charge me 5% of the outstanding balance on which interest is charged as at the date on which I repay the loan. I have been charged an early repayment charge of £577.62.

 

I have also been charged a repayment charge of £100.00. This I assume is in the contract which states that if I make a repayment of more than £1000.00 then they will charge me 5% of the repayment amount.

 

The contract does state that their legal costs would be paid by myself if I started proceedings against them.

 

My questions are:

1. At this moment in time, what charges do I claim back.

2. Which spreadsheet do I use, I have started using the credit card spreadsheet, as I could not find a mortgage one.

3. What happends if I have to take them to Court with regard their costs.

 

Will someone please clarify the position as much as possible as I feel there is a bit of confusion with regard what I can definately claim for and the procedure for doing so.
